                <div style="text-align: justify"><br /></div><div style="text-align: justify">The Centre is planning a few amendments to key education reform bills whose legislative progress has been stalled by opposition to several of their clauses.</div><div style="text-align: justify"><br /></div><div style="text-align: justify">The Telegraph had reported how private educational institutions had been arguing that the &ldquo;draconian&rdquo; bills would make it difficult for new colleges and universities to be opened, and would threaten institutional heads with stringent punishment for minor mishaps.</div><div style="text-align: justify"><br /></div><div style="text-align: justify">Human resource development ministry sources now say they propose to introduce certain changes to the National Accreditation Regulatory Authority for Higher Educational Institutions Bill and the Prohibition of Unfair Practices in Technical Educational Institutions, Medical Educational Institutions and Universities Bill (see chart).</div><div style="text-align: justify"><br /></div><div style="text-align: justify">One of the changes has been necessitated by the extremely slow progress of a third higher-education bill, the Educational Tribunal Bill which proposes to set up such tribunals across India.</div><div style="text-align: justify"><br /></div><div style="text-align: justify">The bill on accreditation, which sought to make accreditation mandatory before an institution can admit students, also said any institution denied accreditation could appeal only to an educational tribunal. Similarly, the bill to check unfair practices said any affected student could file a petition only before an educational tribunal.</div><div style="text-align: justify"><br /></div><div style="text-align: justify">These clauses meant that the accreditation and unfair practices bills could have been implemented only after the passage of the tribunal bill. The bill on accreditation, which sought to make accreditation mandatory before an institution can admit students, also said any institution denied accreditation could appeal only to an educational tribunal. Similarly, the bill to check unfair practices said any affected student could file a petition only before an educational tribunal. These clauses meant that the accreditation and unfair practices bills could have been implemented only after the passage of the tribunal bill. Since this third bill is stuck, the ministry has now decided to de-link the other two bills from it, the sources said. This means the complaints under the other two bills can be taken directly to the courts. “The idea is that even if the tribunal bill is not passed, the other bills can be passed and implemented,” a ministry official said. Certain forums such as the Education Promotion Society of India had objected to the provision asking institutions to appeal only before educational tribunals. As for the revised accreditation bill, it is expected to demand that a new institution satisfy a team of inspectors that it fulfils a set of minimum infrastructural and faculty requirements. Accreditation can be obtained two years later, based on actual performance. The bill to check unfair practices has been strengthened by including under it any kind of “discrimination” against any student on the grounds of religion, gender, caste and the like. The proposed amendments will need cabinet approval before the revised bills can be re-introduced in Parliament.
