Changes in law against sexual abuse sought by Aarti Dhar

Women’s groups have demanded a comprehensive legislation to address rape and sexual assault. A delegation that met Union Law Minister Veerappa Moily earlier this week, said there was a need to incorporate various substantive and procedural sections in the Indian Penal Code, Criminal Procedure Code and the Indian Evidence Act to deal with child sexual assault and sexual assault against women. Archaic definition In a memorandum to the Minister, the women’s groups pointed out that the definition of sexual assault and rape in the IPC was totally archaic, restrictive and inadequate. “We feel that the section defining outraging the modesty of women needs to be redefined as unlawful sexual contact and the law should differentiate between the molestation of a woman and that of a minor…harsher punishments should be prescribed under this section as molestation covers the entire range of sexual abuse which is not covered by the section on rape,” the memorandum said. Some procedural amendments relating to police investigation, medical examination of the victim, video taping of the statement, separation of the child victim and the accused in the courtroom have been introduced in the Code of Criminal Procedure (Amendment) Act, 2008 but more needs to be done in this direction, it said. The delegation, led by CPI(M) MP Brinda Karat, welcomed the proposed Sexual Offences (Special Courts) Bill, which envisages making trials in rape cases time-bound, and also proposed other procedural measures to improve the justice delivery mechanism. The signatories to the memorandum include All India Democratic Women’s Association, All India Women’s Conference, National Federation of Indian Women, Joint Women’s Programme, Centre for Women’s Development Studies, Young Women’s Christian Association, Guild of Services, Muslim Women’s Forum and All India Dalit Mahila Adhikar Manch. The Union Tourism Ministry has circulated a draft code of conduct to prevent sexual exploitation of women and children by tourists. Signing up for compliance with the code will demonstrate the commitment of the service provider to socially responsible tourism. The proposed code is an instrument for the tourism industry to prevent sexual exploitation and envisages drawing up an ethical policy. The code makes it mandatory to train the personnel in the industry against exploitation of children and introducing a clause of repudiation of the menace.
