$disp = '<div align="justify">-The Times of India</div><p align="justify"><br /><em>NEW DELHI: </em>The Delhi HC order empowering CAG to audit private telecom companies would not only kick off a massive audit exercise,but also ensure that CAG is empowered to audit PPPs (public-private partnerships), and similar engagements where private sector is engaged in some of the traditional government functions.</p><p align="justify">&quot;It is a landmark judgment, it will be quoted and discussed for years to come,&quot; a senior audit official said, pointing out that this dramatically alters the audit landscape and increases CAG's workload.</p><p align="justify">CAG has for long been advocating that the government should come up with necessary changes in law to give it ample powers to audit PPP projects. There are several roadblocks, including the fact that many of the contracts signed between the government and private operators, such as the one between department of telecommunications and mobile firms, do not mandate the CAG to be the auditor on behalf of the government agency. So, in many instances when private entities have to be audited, the President or governors are required to ask the CAG to audit under section 20 of CAG Act.</p><p align="justify">Despite such limitations, CAG has in the past audited several private operations, JVs between government and private entities and PPPs,the most famous instance being the audit of KG D-6 basin operated by Reliance and other gas exploration operations. CAG is also now in the process of reviewing the functioning of a number of road infrastructure projects under the National Highways Authority of India.</p><p align="justify">Asenior auditor pointed out that the order means a huge amount of work for CAG, but it also firms up CAG's role in the new era. &quot;Today remittances to the Consolidated Fund of India flow significantly via private firms. If you keep them out of CAG's ambit how the government and public would know what is actually due to the public exchequer,&quot; asked a senior official.</p><p align="justify">The recent order of the Delhi government to audit discoms by CAG would also be a precedent across the country, and for many sectors. Many are also pointing out that CAG should be the mandated audit agency on behalf of the government in all contracts where private players are involved. Otherwise, the possibility of the whims and fancies of individuals holding offices having a play is significant.</p><p align="justify">Whenever CAG has looked at the private sector it has also come up with damning indictments. For example, the CAG in its audit report on the functioning of country's 11 major ports has termed the National Maritime Development Programme almost a failure.</p>'
