Facilities in schools: Principal Secretary told to be present in court

The Karnataka High Court on Monday directed the Principal Secretary, Primary Education Department, to be present in court on January 10 as it was not satisfied with the reply given by the government counsel regarding the action-taken report that was to be submitted to the court on providing toilets and drinking water facility in all government schools in the State.

The Division Bench comprising Chief Justice Vikramajit Sen and Justice B.V. Nagarathna passed the order while hearing a public interest litigation (PIL) petition on the lack of toilets and drinking water facility in government primary and secondary schools. The Government in April 2011 had assured the court that drinking water facility and toilets would be provided in all government pre-primary, primary and secondary schools by December 31, 2011. The Government was to submit an action-taken report in the form of an affidavit stating the number of schools to which these facilities were provided and the amount incurred in this regard to the High Court on Monday.

However, as no affidavit was filed and there was no proper reply from the government counsel in this regard, the Bench directed the Principal Secretary to be present in court.

Use of loudspeakers

Meanwhile, the Bench ordered issue of notice to the State Government, the police and the Karnataka State Pollution Control Board (KSPCB) on a PIL petition complaining about the illegal use of loudspeakers by religious institutions.

In its petition, Jayanagara Nagarikara Samiti, Bangalore, said that many religious institutions were using loudspeakers without obtaining permission as per the Karnataka Police Act and in violation of the guidelines imposed by the Apex Court in its direction issued in 2005.

It was also pointed out that the reply given by some of the police stations to queries sought under the RTI Act revealed that none of the religious institutions had applied for permission nor had the police granted permission to use loudspeakers.

Orally observing that it was a serious issue, the Bench directed the authorities to submit replies by January 30.
