The order came on Badshahpur resident Devendra Kumar&amp;rsquo;s plea on violation of provisions of the notification issued by the Ministry of Environment and Forests on May 7, 1992 that prohibited certain activities in the Aravalli Hills in Gurgaon.&lt;br /&gt;
&lt;br /&gt;
The applicant had specifically mentioned that illegal activities were being carried by marble traders and others on a particular khasra of Sikandarpur Ghosi village. The encroachers were felling trees, adversely affecting the environment.&lt;br /&gt;
&lt;br /&gt;
Observing that there was clear violation of the 1992 notification on protection of environment, the Tribunal Bench, headed by Justice Swatanter Kumar, in its March 14 order directed that no one would be permitted to construct any road or cut trees or bush in the area covered under the notification.&lt;br /&gt;
&lt;br /&gt;
The Bench further directed that each of the non-applicants would plant at least 50 trees and look after them. Restricting people from throwing debris at the site, the Bench sought demolition of all sheds of temporary or permanent nature within two weeks from the pronouncement of the order. It also directed those carrying on the business of gas cylinders and liquor in the area to stop their activities within three months and one month respectively.&lt;br /&gt;
&lt;br /&gt;
Directing the parties concerned to restore the area to its original natural condition, the Bench constituted a committee comprising Haryana Pollution Control Board environmental engineer, the Sub-Divisional Magistrate concerned and a senior forest officer to ensure execution of the order.&lt;br /&gt;

Refraining from passing any coercive directions against government agencies, the Bench observed: &amp;ldquo;The Forest Department of the State of Haryana, the Municipal Corporation of Gurgaon and the Haryana State Pollution Control Board have erred in proper implementation of the provisions of the notification... we are of the opinion that without their knowledge, it was practically impossible for such large number of marble traders to not only establish their shops/godowns but also enjoy the power back-up facilities and be able to use their machineries.&amp;rdquo;

The Tribunal also set up a three-member committee to monitor the execution of the order.<br /><br />The order came on Badshahpur resident Devendra Kumar&rsquo;s plea on violation of provisions of the notification issued by the Ministry of Environment and Forests on May 7, 1992 that prohibited certain activities in the Aravalli Hills in Gurgaon.<br /><br />The applicant had specifically mentioned that illegal activities were being carried by marble traders and others on a particular khasra of Sikandarpur Ghosi village. The encroachers were felling trees, adversely affecting the environment.<br /><br />Observing that there was clear violation of the 1992 notification on protection of environment, the Tribunal Bench, headed by Justice Swatanter Kumar, in its March 14 order directed that no one would be permitted to construct any road or cut trees or bush in the area covered under the notification.<br /><br />The Bench further directed that each of the non-applicants would plant at least 50 trees and look after them. Restricting people from throwing debris at the site, the Bench sought demolition of all sheds of temporary or permanent nature within two weeks from the pronouncement of the order. The Tribunal also set up a three-member committee to monitor the execution of the order.<br /><br />The order came on Badshahpur resident Devendra Kumar&rsquo;s plea on violation of provisions of the notification issued by the Ministry of Environment and Forests on May 7, 1992 that prohibited certain activities in the Aravalli Hills in Gurgaon.<br /><br />The applicant had specifically mentioned that illegal activities were being carried by marble traders and others on a particular khasra of Sikandarpur Ghosi village. The encroachers were felling trees, adversely affecting the environment.<br /><br />Observing that there was clear violation of the 1992 notification on protection of environment, the Tribunal Bench, headed by Justice Swatanter Kumar, in its March 14 order directed that no one would be permitted to construct any road or cut trees or bush in the area covered under the notification.<br /><br />The Bench further directed that each of the non-applicants would plant at least 50 trees and look after them. Restricting people from throwing debris at the site, the Bench sought demolition of all sheds of temporary or permanent nature within two weeks from the pronouncement of the order. It also directed those carrying on the business of gas cylinders and liquor in the area to stop their activities within three months and one month respectively.<br /><br />Directing the parties concerned to restore the area to its original natural condition, the Bench constituted a committee comprising Haryana Pollution Control Board environmental engineer, the Sub-Divisional Magistrate concerned and a senior forest officer to ensure execution of the order.<br /><br />Refraining from passing any coercive directions against government agencies, the Bench observed: &ldquo;The Forest Department of the State of Haryana, the Municipal Corporation of Gurgaon and the Haryana State Pollution Control Board have erred in proper implementation of the provisions of the notification... we are of the opinion that without their knowledge, it was practically impossible for such large number of marble traders to not only establish their shops/godowns but also enjoy the power back-up facilities and be able to use their machineries.&rdquo;</div>               </font>

The encroachers were felling trees, adversely affecting the environment.&lt;br /&gt;&lt;br /&gt;Observing that there was clear violation of the 1992 notification on protection of environment, the Tribunal Bench, headed by Justice Swatanter Kumar, in its March 14 order directed that no one would be permitted to construct any road or cut trees or bush in the area covered under the notification.&lt;br /&gt;&lt;br /&gt;The Bench further directed that each of the non-applicants would plant at least 50 trees and look after them. Restricting people from throwing debris at the site, the Bench sought demolition of all sheds of temporary or permanent nature within two weeks from the pronouncement of the order. Green Tribunal bans construction of roads, cutting of trees in Aravallis-Ashok Kumar

-The Hindu Sets up a three-member panel to monitor execution of the order Gurgaon: The National Green Tribunal has through a recent order banned construction of roads and cutting of trees in the Aravallis directing the parties concerned to restore the area to its original condition. The Tribunal also set up a three-member committee to monitor the execution of the order. The order came on Badshahpur resident Devendra Kumar’s plea on violation of provisions of the notification issued by the Ministry of Environment and Forests on May 7, 1992 that prohibited certain activities in the Aravalli Hills in Gurgaon. The applicant had specifically mentioned that illegal activities were being carried by marble traders and others on a particular khasra of Sikandarpur Ghosi village. The encroachers were felling trees, adversely affecting the environment. Observing that there was clear violation of the 1992 notification on protection of environment, the Tribunal Bench, headed by Justice Swatanter Kumar, in its March 14 order directed that no one would be permitted to construct any road or cut trees or bush in the area covered under the notification. The Bench further directed that each of the non-applicants would plant at least 50 trees and look after them. Restricting people from throwing debris at the site, the Bench sought demolition of all sheds of temporary or permanent nature within two weeks from the pronouncement of the order. It also directed those carrying on the business of gas cylinders and liquor in the area to stop their activities within three months and one month respectively. Directing the parties concerned to restore the area to its original natural condition, the Bench constituted a committee comprising Haryana Pollution Control Board environmental engineer, the Sub-Divisional Magistrate concerned and a senior forest officer to ensure execution of the order. Refraining from passing any coercive directions against government agencies, the Bench observed: “The Forest Department of the State of Haryana, the Municipal Corporation of Gurgaon and the Haryana State Pollution Control Board have erred in proper implementation of the provisions of the notification... we are of the opinion that without their knowledge, it was practically impossible for such large number of marble traders to not only establish their shops/godowns but also enjoy the power back-up facilities and be able to use their machineries.”
