If the commission is working, it is despite non-cooperation from the State Government in providing adequate staff and space and, worse still, active efforts by government representatives to bring discredit to the commission by indulging in &ldquo;ill-conceived, motivated and misleading&rdquo; attacks. Addressing a press conference on the eve of International Human Rights Day here on Wednesday, Justice Nayak came down heavily on the State Government for its inability to facilitate meaningful and free functioning of the commission.</font></p><p align="justify"><font >As against the staff strength of 501 sought by the commission, the State Government has sanctioned only 81 personnel. </font></p><p align="justify"><font >Of these, only 66 have been appointed, and even they are either on deputation or on contract. </font></p><p align="justify"><font >A separate investigation wing of its own and more people in the law division are an urgent need, said Justice Nayak.</font></p><p align="justify"><font >The manpower crunch has resulted in the commission remaining largely Bangalore-centric, but for sporadic visits as and when cases come up in other parts of the State. The manpower crunch has resulted in the commission remaining largely Bangalore-centric, but for sporadic visits as and when cases come up in other parts of the State. The commission requires a minimum 20,000 sq. ft of space, but has been provided only 4,500 sq. ft. The Cadre and Recruitment Rules of the commission are yet to be notified. Apart from these problems are those imposed by active interference by politicians. A blatant instance of this was the verbal attack by a few Bharatiya Janata Party functionaries when Justice Nayak chided the Government for holding sessions for Ministers in a resort while north Karnataka was reeling under floods. “It is our duty to highlight lapses when they occur of people in power,” said Justice Nayak. “They should respond responsibly,” he added. ‘Gravest threat’ “In most cases, the gravest threats to the human rights of citizens and defenders of human rights emanates from the agencies of the State. We should realise that when the rights of defenders of human rights like the commission are violated, all our rights are put in jeopardy and all of us are made less safe.” He said that the State Government should not do anything directly or indirectly to “thwart or hinder the commission’s proper functioning or cause damage to its reputation and honour”.
