In a ruling on Friday, the high court ordered status quo on the private land being acquired by the state government that is vital for building the steel plant. The court, however, refused to grant an interim stay on forest land acquisition. &lt;br /&gt;
&lt;br /&gt;
A division bench comprising Chief Justice V Gopala Gowda and Justice BN Mahapatra ruled that staying land acquisition in forest area would not be in public interest for a project of this scale. &lt;br /&gt;
&lt;br /&gt;
But it stayed land acquisition notification under Section 6(1) of LA Act for private land, in the project area, ordering that status quo be maintained. &lt;br /&gt;
&lt;br /&gt;
A lawyer for the petitioners, Jayant Das told ET that they would move another petition before the court to seek a stay on tree-felling by Posco in the acquired land. &lt;br /&gt;
&lt;br /&gt;
The development is likely to delay the project further, which has seen opposition from local villagers who resisted government&#039;s efforts to clear the project site. &lt;br /&gt;
&lt;br /&gt;
The compensation paid to some villagers was considered low, prompting many earlier supporters of the project to rise against the project. &lt;br /&gt;

In May last, Nishakar Khatua and five others from Gobindpur village under Dhinkia panchayat of Jagatsinghpur district, filed two separate public interest litigations stating that the forest clearance granted to the company has been done contrary to Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act of 2006. &lt;br /&gt;
&lt;br /&gt;
Posco has sought 3,719.22 acres for its 12-million tonne steel mill and has so far acquired over 2,000 acres of government land. But it has not been able to make any headway in the all-important villages of Dhinkia and Govindpur. &lt;br /&gt;
&lt;br /&gt;
The private land is spread over an area of about 437.66 acres, which Posco says it does not need at the moment. &lt;br /&gt;
&lt;br /&gt;
The petitioners also prayed for quashing forest clearance granted by the Union ministry of environment and forests for the project and halting the land acquisition. The court, however, refused to grant an interim stay on forest land acquisition. <br /><br />A division bench comprising Chief Justice V Gopala Gowda and Justice BN Mahapatra ruled that staying land acquisition in forest area would not be in public interest for a project of this scale. <br /><br />But it stayed land acquisition notification under Section 6(1) of LA Act for private land, in the project area, ordering that status quo be maintained. <br /><br />A lawyer for the petitioners, Jayant Das told ET that they would move another petition before the court to seek a stay on tree-felling by Posco in the acquired land. <br /><br />The development is likely to delay the project further, which has seen opposition from local villagers who resisted government's efforts to clear the project site. <br /><br />The compensation paid to some villagers was considered low, prompting many earlier supporters of the project to rise against the project. <br /><br />In May last, Nishakar Khatua and five others from Gobindpur village under Dhinkia panchayat of Jagatsinghpur district, filed two separate public interest litigations stating that the forest clearance granted to the company has been done contrary to Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act of 2006. <br /><br />Posco has sought 3,719.22 acres for its 12-million tonne steel mill and has so far acquired over 2,000 acres of government land. But it has not been able to make any headway in the all-important villages of Dhinkia and Govindpur. <br /><br />The private land is spread over an area of about 437.66 acres, which Posco says it does not need at the moment. <br /><br />The petitioners also prayed for quashing forest clearance granted by the Union ministry of environment and forests for the project and halting the land acquisition. Jolt to Posco in Odisha as High Court stays the acquisition of land by Nageshwar Patnaik

-The Economic Times   The Orissa High Court on Friday stayed the acquisition of land for building the much-delayed 12-million tonne Posco project, dealing a further setback to the India plans of the South Korean steel major which has not been able to progress much for the past five years. In a ruling on Friday, the high court ordered status quo on the private land being acquired by the state government that is vital for building the steel plant. The court, however, refused to grant an interim stay on forest land acquisition. A division bench comprising Chief Justice V Gopala Gowda and Justice BN Mahapatra ruled that staying land acquisition in forest area would not be in public interest for a project of this scale. But it stayed land acquisition notification under Section 6(1) of LA Act for private land, in the project area, ordering that status quo be maintained. A lawyer for the petitioners, Jayant Das told ET that they would move another petition before the court to seek a stay on tree-felling by Posco in the acquired land. The development is likely to delay the project further, which has seen opposition from local villagers who resisted government's efforts to clear the project site. The compensation paid to some villagers was considered low, prompting many earlier supporters of the project to rise against the project. In May last, Nishakar Khatua and five others from Gobindpur village under Dhinkia panchayat of Jagatsinghpur district, filed two separate public interest litigations stating that the forest clearance granted to the company has been done contrary to Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act of 2006. Posco has sought 3,719.22 acres for its 12-million tonne steel mill and has so far acquired over 2,000 acres of government land. But it has not been able to make any headway in the all-important villages of Dhinkia and Govindpur. The private land is spread over an area of about 437.66 acres, which Posco says it does not need at the moment. The petitioners also prayed for quashing forest clearance granted by the Union ministry of environment and forests for the project and halting the land acquisition. Nishakar Khatua, along with others had filed the petitions in the HC challenging the forest clearance and other approvals granted by the Union and the state governments to the Posco project.
