                <p align="justify"><font >The Centre's fresh move to create 15,000 more courts appears to have fallen short of the estimation of Chief Justice of India K G Balakrishnan as he thinks the lower judiciary needs at least 35,000 judges as against the existing 16,000 to tackle the huge backlog of 2.71 crore cases. </font></p><p align="justify"><font >Law minister Veerappa Moily's initiative saw the cabinet clear a decision to create 15,000 more courts, but a Bench comprising CJI and Justice B S Chauhan felt that the litigant's right to speedy justice could be meaningful only if a minimum of 20,000 more judges' posts were created for the trial courts. </font></p><p align="justify"><font >The Bench virtually agreed with the submission of NGO `Janhit Manch' counsel Prashant Bhushan that the Centre and states were spending a pittance of the GDP on the judiciary yet joining the chorus with the public that the justice delivery system was snail paced. </font></p><p align="justify"><font >Justice Balakrishnan said though the Centre has agreed to bear 50% infrastructural cost involved in setting up of additional courts, the cash-strapped states were reluctant to pitch in with their share. &quot;I feel unless the Centre agrees to bear 70% of the cost, the states would remain reluctant,&quot; he said. </font></p><p align="justify"><font >He said there are 16,609 sanctioned posts of judges in the lower judiciary, but invariably around 2,000 posts remain vacant as the recruitment and training of judges involved a two-year-long process. Justice Balakrishnan said though the Centre has agreed to bear 50% infrastructural cost involved in setting up of additional courts, the cash-strapped states were reluctant to pitch in with their share. "I feel unless the Centre agrees to bear 70% of the cost, the states would remain reluctant," he said. He said there are 16,609 sanctioned posts of judges in the lower judiciary, but invariably around 2,000 posts remain vacant as the recruitment and training of judges involved a two-year-long process. By the time the vacancies were filled, the retirements kept the vacancy position intact, he said. "We would require a pool of 2,000 additional judges at all points of time to take care of the vacancies and operate the lower judiciary at the sanctioned strength level. But, the state governments do not account for the salary of additional judges leaving no room for timely augmentation of the judges strength," the CJI said.
