The ministry told the court today that following the state’s action, it would reconsider its October 13 decision, and a final order would be passed within three weeks. The division bench of Justice D.D. Sinha and Justice V.K. Tahilramani told the state government and the Union ministry that the time of three weeks “will not be extended under any circumstance”. “The state, in spite of the communication on June 10, did not initiate action for violation of environmental provisions,” Justice Sinha said. “Are you proposing to take action or not? The state must make its stand clear,” he told state counsel S.K. Shinde. Shinde said the state government would take “credible action” against the project in two weeks. Action could be taken against the project under Section 15 of the Environment (Protection) Act, 1986, which has provisions for imprisonment of up to five years or a fine that may be Rs 1 lakh, or both. “Action under this section would involve criminal proceedings and prosecution, which would mean involving the persons who were the directors of the company in 2004,” said lawyer Y.P. Singh, who represents the National Alliance of People’s Movement that filed a PIL against the project near Pune. In its last hearing on September 23, the court directed the Union environment ministry to give its final order in three weeks. It noted today that “the order placed before this court shows that final decision has not been passed (on October 13)…. Since the permission was granted by the court to pass a final order, it was necessary for the MoEF (ministry for environment and forests) to consider the application on its merit and decide either by rejecting or allowing clearance. The union ministry did not do either.” The next hearing is on November 16. |
