Marriage Bill hits minority hurdle, sent to review panel-Naziya Alvi

Delhi government's long pending Delhi Registration of Marriage Bill ran into trouble on Monday with some MLAs raising questions on its implications on the Muslim community.  Objecting to the Bill being passed in the Assembly, Lok Janshakti Party MLA Shoaib Iqbal said that women can misuse the Bill to deny being divorced. They can also misuse it to get a claim in their husbands' property or to harass them after the pronouncement of triple talaq, he said.  "Also, the Bill is silent on the procedure for registration in case of those men who have been married more than once. These are some issues that the government needs to consider before turning it into an Act," he said. Another discrepancy pointed out by Iqbal was that the Bill allows registration of a marriage in the presence of one witness whereas a Muslim marriage is only validated in the presence of two witnesses. "A nikahnama is proof enough for a Muslim marriage. Such a registration is not necessary," said Iqbal who found a supporter in Congress MLA Vijender Singh.  The Bill has now been sent to a select committee for review. It has been a topic of debate for two years and has been cleared by Delhi cabinet and the home ministry twice. Delhi revenue minister A K Walia, who had introduced the Bill in the Assembly, refrained from commenting on the issue. "Let the committee look into the matter," he said.  As per the proposed Act, if one fails to register a marriage within 60 days of the wedding, he will have to cough up a penalty of Rs 10,000. It also suggests a three-month jail term for those who provide false information. In 2006, the Supreme Court had made the registration of marriages compulsory in a landmark judgement.
