MP Catholic organisation challenges RTE by Milind Ghatwai

Accusing the government of interfering in the affairs of minority institutions, the Catholic Bishops Conference of Madhya Pradesh has challenged the implementation of the Right to Education Act in the state.

A division bench of the Madhya Pradesh High Court on Wednesday issued notices to the Principle Secretary (school education), the Directorate of Public Instructions and the District Education Officer in Bhopal. Advocate Jamesh Anthony, who appeared for the Conference, argued that educational institutions run by the minorities enjoyed constitutional privileges.

Challenging the gazette notification issued by the MP government to implement the legislation, the petitioner alleged that the schools were being made to admit students against their wishes. The government was interfering in their administrative matters and also wanted to fix the fee structure, the petitioner alleged calling the notification unconstitutional.

The institutions were worried about the possibility of falling quality because students to be admitted under the new legislation were being selected by a lottery system, said petitioner Anand Muttungal, who is also spokesman of the Catholic Church.

The division bench headed by Chief Justice Rafat Alam has given the respondents two weeks to file their replies.
