NAC panel drafts pre-legislative process-Anuja |
-Live Mint The Sonia Gandhi -led National Advisory Council (NAC) may be moving closer to formulating a pre-legislative process that will involve a thorough, time-bound discussion of Bills before they become law. “The need for such a policy of consultation is necessary to evolve from a representative democracy to a participatory, deliberative democracy, particularly for accountability to the people in the formulation of law and policy,” said the draft recommendation of NAC’s working group on transparency, accountability and governance. “However, it is not an attempt to replace the legislative parliamentary process.” The scope of the measure extends to new laws and rules and their amendments, ratification of ordinances and national and state policies. The move is likely to renew the debate on public participation in drawing up laws in India. Mint has reviewed a copy of the draft recommendations. This comes in a climate of confrontation between the government and the opposition over alleged wrongdoing in coal block allocations that stalled proceedings in Parliament.
In June last year, soon after the government constituted a joint draft committee on the Lokpal to engage with civil society representatives headed by Anna Hazare, NAC had formally floated the idea of evolving a policy on a “pre-legislative consultative process” that would be recommended to the Congress-led United Progressive Alliance (UPA) administration. NAC sets the social agenda of the government. NAC, in its draft recommendations, has suggested that the pre-legislative process should involve pro-active disclosure including broad financial implications of any proposed policy decision, consultation with stakeholders including gram sabhas (village councils) and compilation of feedback. “The key thrust of the recommendations is promoting transparency of policy issues and a mandatory pro-active disclosure. So it has been made applicable to any legislative change,” said a person familiar with the development who didn’t want to be named. Under such pro-active disclosure, the “essential principles and objectives of proposed policy or legislation or rule” should be kept in the public domain for 45 days and the proposed draft for the policy should be kept for 90 days. The drafts should also be “accompanied by a set of questions/standard format” to seek feedback. Chakshu Roy, an analyst at the PRS Legislative Research, said that the suggestion of NAC for making legislation processes time-bound could help put in place a more structured approach to framing laws. “There is a need to think about legislation in a more structured way, which is missing right now. NAC is sort of setting a time-table by talking about the 45 and the 90 days limit, which is definitely a good step,” he said. “Pre-legislative processes will make the passage of Bills in the Parliament easier as most of the issues will get sorted before they reach the floor of the House.” There is emphasis on disseminating information through websites, newspapers, radio and information facilitation centres at block levels. The working group of the council is likely to have a meeting with the department of personnel and training , following which the recommendations will be discussed at NAC and later published for feedback, the person cited above said. |
