Deo feels the draft land acquisition bill does not adequately protect the Scheduled Tribes&rsquo; rights in case they have to be displaced to a non-scheduled area.<br /><br />Deo told The Telegraph he would write to rural development minister Jairam Ramesh about this.<br /><br />&ldquo;Tribal people enjoy constitutional protection in the scheduled areas. If they are displaced for a certain project and resettled outside the scheduled area, the question is whether they will continue to enjoy the same protection. This has to be addressed in the bill,&rdquo; Deo said.<br /><br />Under the Constitution, &ldquo;scheduled areas&rdquo; refer to areas with a preponderant tribal population. These areas are generally backward compared with neighbouring localities.<br /><br />Several states with scheduled areas have regulations restricting land transfer from tribals to non-tribals.<br /><br />Under the draft land acquisition bill, displaced tribal families are to be relocated to resettlement colonies and will receive one acre of land each.<br /><br />&ldquo;But if they are rehabilitated in non-scheduled areas, they should get the same protection that they enjoy in a scheduled area,&rdquo; Deo said.<br /><br />For instance, he said, under the tribal sub-plan, the Centre provides assistance to states for specific area development projects and schemes for small and economically marginalised groups.<br /><br />&ldquo;If tribal people are rehabilitated in other areas, they should continue to get the benefits they receive under the tribal sub-plan,&rdquo; Deo said.<br /><br />N.C. Several states with scheduled areas have regulations restricting land transfer from tribals to non-tribals.<br />

Under the draft land acquisition bill, displaced tribal families are to be relocated to resettlement colonies and will receive one acre of land each.<br />
<br />
&ldquo;But if they are rehabilitated in non-scheduled areas, they should get the same protection that they enjoy in a scheduled area,&rdquo; Deo said.<br />
<br />
For instance, he said, under the tribal sub-plan, the Centre provides assistance to states for specific area development projects and schemes for small and economically marginalised groups.<br />

&ldquo;If tribal people are rehabilitated in other areas, they should continue to get the benefits they receive under the tribal sub-plan,&rdquo; Deo said.<br />

N.C. Saxena, member of the National Advisory Council and the bill drafting committee, said Deo&rsquo;s points were valid.<br />
<br />
&ldquo;The bill has a lot of provisions for tribal people. For example, if a tribal family is resettled in a different state after land acquisition, it will continue to have reservation rights and other benefits,&rdquo; he said.<br />
<br />
&ldquo;But the additional points raised by Deo (on land transfer and development and welfare schemes) are pertinent. I&rsquo;m sure the rural development ministry will consider them.&rdquo;<br />
<br />
The draft bill says tribal families should be resettled preferably in the same scheduled area. But it also makes a few special provisions for those who may be resettled outside the scheduled area.<br />
<br />
For instance, they will get 25 per cent higher monetary benefits than those resettled in the same district in case of land acquisition by industry or any other private body.<br />

Also, resettlement colonies predominantly inhabited by the Scheduled Tribes are to get land free of cost for community gatherings. <br />
