The concept of a “parallel” school for children from “weaker sections” of the society evoked strong words of reproach from the Delhi High Court on Wednesday as it pulled up Sanskriti School, primarily catering to children of senior bureaucrats, for making sub-classes even in education. “What do you mean by a parallel school?” a Division Bench of Chief Justice A P Shah and Justice S Muralidhar asked. “The children of the economically weaker sections must sit in the same classroom sharing the same bench as that of your senior public officers’ group. “You cannot make the so-called parallel school’s children (sit) in veranda.” The court made the observation after being apprised of “Umang,” a school separately run by Sanskriti School for children coming from weaker sections of the society. The court also criticised the school for making a distinction between not only the poor and affluent, but also between different categories of public servants. “What you are using is public money and you are not doing any charity by teaching the children belonging to weaker classes,” the court observed. “You cannot just teach children of IAS officers — have no doubts regarding whose money you use.” In 2006, the Bench had taken suo motu cognizance of a media report that Sanskriti School was being run by wives of top bureaucrats, and that the officers grant public money from concerned departments. It emerged during the hearing that while reservations were for public servants, only senior-level officers had the advantage. “You cannot have reservation only for the IAS cadre,” the Bench said. “You have to admit children of all categories of public servants. “Some benefits being given on account of jobs being transferable can be understood but nothing more than this is acceptable.” The court made it clear to the school’s counsel that the institution could not use land and money given by the government to teach the children of only Class-I officers. Solicitor General Gopal Subramaniam, who was sitting in the courtroom to attend another matter, intervened and told the Bench that its concerns were very right and a change is required in the ways things are working in the school. Trying to pacify the Bench, Subramaniam said he would take instructions from the Centre and would try to reach a just and fair decision by mutual consent. But the Bench retorted: “You already have 931 Kendriya Vidyalayas for catering to wards of government officers. We cannot understand how can anybody use several hectares of land and crores of money to teach only the children of particular public servants.” The Bench also sought to know from the school the basis on which it reserved seats for the poor students. The matter has now been adjourned for January 13 for the school’s response. |
