Both the Saxena and Meena Gupta Committees, set up by the MoEF to probe into alleged violation of the Forest Regulation Act by Posco, had pointed out that 21 adivasis have been residing in the forest that falls in the project area. Both Posco and the state government strongly deny this. The Posco steel project is scheduled to produce 12 million tonnes of steel, which is equal to what six PSU plants (Bhilai, Bokaro, Durgapur, Rourkela, Burnpur and Salem) currently produce. The Forest Advisory Committee (FAC), under the MoEF, on Tuesday reviewed both the reports submitted by the Meena Gupta committee which had given divergent views on the forest right status at the project site. Meena Gupta, however, in her report said that since there were no tribals where the project is located, there was no question of violation of the Forest Rights Act. "It is a fact that the area is not a Scheduled Area (defined under Schedule V of Constitution) and that there are very few Scheduled Tribe persons in the area. As per the voters list of 2007, provided to us by the state government, the total number of STs in the villages in question was less than 30. Therefore, the possibility of there being ST forest dwellers is very unlikely." But, she does mention that there could be Other Traditional Forest Dwellers whose claims need to be settled. The majority report describes Polanga village under the project site as a reserved constituency for Scheduled Tribes under the Gadkujang gram panchayat. However, the Orissa government on Monday submitted before the FAC that there was no forest and no violation of green laws and people hit by the project would get "good" compensation. On November 7, two Expert Appraisal Committees on coastal regulation zone and infrastructure will also look into alleged violations by the steel project. The Posco project has been hanging on fire since August 5 when MoEF halted construction work and land acquisition citing alleged violation of green norms. BJP state president Jual Oram hit out at the Naveen Patnaik government for what he called "acting as agents for these industrial houses and (for) flouting all environmental, forest and tribal laws". "It is a stark reminder of the draconian and despotic methods that the government adopted to ensure that the clearances were given at all cost. The incidents at Kalinganagar and Balitutha, where the might of the state was used to crush any opposition to the projects, even at the cost of lives, shows the anti people, anti poor and pro-rich attitude of the administration," Mr Oram, who was union minister of tribal affairs during NDA government, said. Meanwhile, the state government has decided to file a special leave petition against Orissa High Court's verdict striking down the recommendation of prospective license for the Khandadahr iron ore mines in favour of Posco India . "We will file the SLP in the Supreme Court in the Posco PL case within three days. The filing of SLP has nothing to do with the FAC decision on the Posco project. The SLP needed to be filed within three months of the receipt of the certified copy of the judgement of the Orissa High Court and in that respect, we still have 3-4 days. There is also a condonation period of 10 days in case the SLP cannot be filed within the stipulated period", Steel and mines secretary Manoj Ahuja told ET. A two-member division bench of the High Court comprising Justice BP Das and Justice BP Ray had directed the state government to take a fresh decision on the recommendation of PL in favour of Posco, giving preferential right of consideration to the petitioner. The High Court had directed the state government to conduct a fresh hearing of all the 226 applicants for the Khandadhar mines. |
