                <div style="text-align: justify">-The Times of India</div><div style="text-align: justify">&nbsp;</div><div style="text-align: justify">The Press Council of India, headed by retired Supreme Court judge, Markandey Katju, has dismissed a complaint filed against The Times of India by a senior Haryana IPS officer, Anil Dawra, who is presently posted as state ADGP (training).&nbsp;</div><div style="text-align: justify"><br /></div><div style="text-align: justify">The TOI on January 28, 2010 had published a story &quot;IG let off easily in Sarita case,&quot; on the basis of an RTI query. Sarita was allegedly raped by two constables at CIA police station, Rohtak on April 10, 2008, where she had gone to get her husband Subhash, detained in connection with a motorcycle theft case, released. CBI, had informed the government about how appropriate action was not taken against the accused, despite the victim's repeated attempts to get an FIR registered against the constables. She was forced to commit suicide at the state police headquarters in June 2008. CBI had raised questions over the role of then Rohtak IG, Anil Dawra and ASP, Sajjan Singh and had recommended that government take action against both the officials as &quot;deemed fit.&quot; The government, however, chose to close the file in August 2009 after accepting their explanations.&nbsp;</div><div style="text-align: justify"><br /></div><div style="text-align: justify">In his complaint to the PCI, Dawra had termed the news item as &quot;false and malicious.&quot; Denying the allegations, Dawra had stated that he has submitted a letter having remarks of SP, Rohtak as &quot;This is an extremely serious matter. Why has the case not been registered so far. Action be initiated at once and report within two days.&quot; In his complaint, the IPS officer has also stated that CBI has given him a clean chit, stating that there is nothing in the investigation which shows that the IG was any time found lacking by police headquarters.&nbsp;</div><div style="text-align: justify"><br /></div><div style="text-align: justify">In its statement to PCI, The Times of India had submitted that it (the story) was the factual reporting based on the CBI report. It further added that the news article was a balanced one written on the basis of a RTI query and nothing malicious was published to malign the complainant (Dawra) as alleged in the complaint. The TOI counsel further stated, &quot;The DGP, Haryana (had) called the explanation&quot; from the complainant (Dawra) and he, vide letter dated May 20, 2009, submitted his reply which was forwarded to the state financial commissioner, home department along with the explanation of Sajjan Singh, ASP and these documents were with the complainant. Sarita was allegedly raped by two constables at CIA police station, Rohtak on April 10, 2008, where she had gone to get her husband Subhash, detained in connection with a motorcycle theft case, released. CBI, had informed the government about how appropriate action was not taken against the accused, despite the victim's repeated attempts to get an FIR registered against the constables. She was forced to commit suicide at the state police headquarters in June 2008. The TOI on January 28, 2010 had published a story &quot;IG let off easily in Sarita case,&quot; on the basis of an RTI query. Sarita was allegedly raped by two constables at CIA police station, Rohtak on April 10, 2008, where she had gone to get her husband Subhash, detained in connection with a motorcycle theft case, released. CBI, had informed the government about how appropriate action was not taken against the accused, despite the victim's repeated attempts to get an FIR registered against the constables. She was forced to commit suicide at the state police headquarters in June 2008. CBI had raised questions over the role of then Rohtak IG, Anil Dawra and ASP, Sajjan Singh and had recommended that government take action against both the officials as &quot;deemed fit.&quot; The government, however, chose to close the file in August 2009 after accepting their explanations.&nbsp;

In his complaint to the PCI, Dawra had termed the news item as &quot;false and malicious.&quot; Denying the allegations, Dawra had stated that he has submitted a letter having remarks of SP, Rohtak as &quot;This is an extremely serious matter. Why has the case not been registered so far. Action be initiated at once and report within two days.&quot; In his complaint, the IPS officer has also stated that CBI has given him a clean chit, stating that there is nothing in the investigation which shows that the IG was any time found lacking by police headquarters.&nbsp;

In its statement to PCI, The Times of India had submitted that it (the story) was the factual reporting based on the CBI report. It further added that the news article was a balanced one written on the basis of a RTI query and nothing malicious was published to malign the complainant (Dawra) as alleged in the complaint. The TOI counsel further stated, &quot;The DGP, Haryana (had) called the explanation&quot; from the complainant (Dawra) and he, vide letter dated May 20, 2009, submitted his reply which was forwarded to the state financial commissioner, home department along with the explanation of Sajjan Singh, ASP and these documents were with the complainant. The PCI dismissed the complaint on March 27 after an inquiry committee recommended the same.&nbsp;
