&amp;quot;We are not against implementing the 25 percent quota in schools, but the directive is not clear and most of the provisions are vague. We did seek a clarification from the state HRD on various issues, but since the department did not respond, we had no option, but to move the court seeking a stay and wait for the SC verdict,&amp;quot; said association president Alfred George D Rosario. &lt;br /&gt;

                <div align="justify">The state government and private school administrations in the state are at loggerheads with the government reiterating its stand to implement the Right to Education (RTE) Act 2010 strictly in Bihar. <br /><br />As many as 15 schools belonging to the Association of Heads of Christian Schools (AHCS) which includes Don Bosco Academy, St Karen's High Schools, St Xavier's School, Christ Church School, St Dominique Savio, Notre Dame Academy, St Joseph's Convent, Loyola High School, St Michael's High School etc. have moved the High Court (HC) on Monday seeking a stay on the implementation of the RTE in these schools, till the Supreme Court verdict comes. <br /><br />&quot;We are not against implementing the 25 percent quota in schools, but the directive is not clear and most of the provisions are vague. We did seek a clarification from the state HRD on various issues, but since the department did not respond, we had no option, but to move the court seeking a stay and wait for the SC verdict,&quot; said association president Alfred George D Rosario. <br /><br />&quot;The association is also ready to follow the random selection procedure in admissions to Class I and nursery, but again the term random selection' is vague. No government is above law,&amp;quot; he said. &lt;br /&gt;&lt;br /&gt;Meanwhile, Patna DM Sanjay Kumar Singh on Tuesday said, &amp;quot;The RTE is not an order of the district administration or the state HRD. &amp;quot;We are not against implementing the 25 percent quota in schools, but the directive is not clear and most of the provisions are vague. We did seek a clarification from the state HRD on various issues, but since the department did not respond, we had no option, but to move the court seeking a stay and wait for the SC verdict,&amp;quot; said association president Alfred George D Rosario. &lt;br /&gt;

&amp;quot;The association is also ready to follow the random selection procedure in admissions to Class I and nursery, but again the term random selection&#039; is vague. We did seek a clarification from the state HRD on various issues, but since the department did not respond, we had no option, but to move the court seeking a stay and wait for the SC verdict,&quot; said association president Alfred George D Rosario. <br />

&quot;The association is also ready to follow the random selection procedure in admissions to Class I and nursery, but again the term random selection' is vague. Even providing quota to poor is also not convincing as to what should be the criteria for selecting those poor children. Apart from all these, minorities have their rights to administer and run their own education institutions according to the Indian Constitution. So how can the government force us to abide by all the provisions of the RTE, said the AHCS president. <br />

&quot;Moreover, the amount of Rs 2,800, which the state government is ready to pay per poor child as school fee and other expenditure per annum is also very meager. How can we get along with such a meager sum keeping the cost of books in view,&quot; said AHCS sources. Incidentally, most of the public schools here are already through with the admission process. Bihar Public School and Children Welfare Association president D K Singh said that though the public schools are adamant to go ahead with their admission process, yet we will definitely abide by the SC order. &quot;Let the SC order come on Thursday and we will disclose our decision. No government is above law,&quot; he said. <br />

Meanwhile, Patna DM Sanjay Kumar Singh on Tuesday said, &quot;The RTE is not an order of the district administration or the state HRD. It is an Act and all schools, be it public or missionary, will have to implement the Act in toto.&quot; Schools, having completed their admission procedure have been asked to submit a detailed report on the number of children admitted and mention whether they have given the required 25 percent quota or not. &quot;Those found violating the law will definitely be brought to the book as implementing the RTE is now their legal responsibility,&quot; added the DM. Chief minister Nitish Kumar at his Janata Durbar on Monday has even asked the SSP to look into the provisions of law under which schools violating RTE can be penalized.<br />
