But he will not write to Goa as the model code of conduct is in place for the Assembly elections.</div><div style="text-align: justify"><br /></div><div style="text-align: justify">&ldquo;The Centre is unhappy at the delay in notification of rules in the four states. The HRD minister will ask the chief ministers to take steps soon,&rdquo; a source said.</div><div style="text-align: justify"><br /></div><div style="text-align: justify">The RTE act came into force on April 1, 2010. The Centre then drew up model rules and asked the states to prepare their own along the same lines and notify them.</div><div style="text-align: justify"><br /></div><div style="text-align: justify">Under the RTE law, there has to be a school in every neighbourhood to help children get free education. But the act does not define the limit of a neighbourhood. The states are supposed to define such limits in their rules.</div><div style="text-align: justify"><br /></div><div style="text-align: justify">Each state is supposed to conduct a survey of neighbourhoods and fix the requirement for new schools. On the basis of the states&rsquo; proposals, the Centre would release funds.</div><div style="text-align: justify"><br /></div><div style="text-align: justify">The RTE act provides for reserving up to 25 per cent seats in private schools for economically backward students. But the states will reimburse the school&rsquo;s expenses according to per-child rates laid down in the rules.</div><div style="text-align: justify"><br /></div><div style="text-align: justify">&ldquo;Without the rules, 50 per cent of the provisions of the law cannot be implemented. It is very important for the remaining states to notify the rules,&rdquo; said Ashok Agrawal, a lawyer who has filed a number of cases against RTE law violations in Delhi.</div><div style="text-align: justify"><br /></div><div style="text-align: justify">The Centre has already stopped grants to errant states for opening new schools.</div><div style="text-align: justify"><br /></div><div style="text-align: justify">&ldquo;Unless we know the exact requirement of new schools, how will the states be provided funds? The HRD minister will ask the chief ministers to take steps soon,” a source said. The RTE act came into force on April 1, 2010. The Centre then drew up model rules and asked the states to prepare their own along the same lines and notify them. Under the RTE law, there has to be a school in every neighbourhood to help children get free education. But the act does not define the limit of a neighbourhood. The states are supposed to define such limits in their rules. Each state is supposed to conduct a survey of neighbourhoods and fix the requirement for new schools. On the basis of the states’ proposals, the Centre would release funds. The RTE act provides for reserving up to 25 per cent seats in private schools for economically backward students. But the states will reimburse the school’s expenses according to per-child rates laid down in the rules. “Without the rules, 50 per cent of the provisions of the law cannot be implemented. It is very important for the remaining states to notify the rules,” said Ashok Agrawal, a lawyer who has filed a number of cases against RTE law violations in Delhi. The Centre has already stopped grants to errant states for opening new schools. “Unless we know the exact requirement of new schools, how will the states be provided funds? The states have to define the neighbourhood limit and conduct a survey to know the requirement,” an official said. The implementation of the law is likely to be further affected as the HRD ministry has not got grants under the supplementary budget in 2011-12. “The ministry has not got funds under the supplementary budget…. We think the construction of new schools and additional infrastructure in existing schools will be affected,” the official said. The budgetary allocation for Sarva Siksha Abhiyan, the main programme for implementing the RTE law, was Rs 21,000 crore in 2011-12. The ministry has released 90 per cent of this amount to the states. It had asked for an additional Rs 5,000 crore under the supplementary budget. Shyama Chona, a former principal of DPS R.K. Puram, said: “The quality of elementary education is still a major concern. This has been reflected in the recent Annual Status of Education Report. A lot has to be done for proper implementation of the law.”
