In Chhattisgarh, the two-year period saw 856 deaths, Haryana 481, Assam 585, Uttarakhand 272 and Himachal Pradesh 709.</p><p align="justify">Quoting Motor Vehicle Rule 93(8), the petitioner said it permitted trucks to carry iron rods protruding up to one or two metre beyond the rear. "Such protrusions are causing severe harm to motorists and other road users. Keeping in mind Indian road and traffic conditions, it is a provision that permitted trucks to imperil the lives of thousands of motorists," the NGO said.</p><p align="justify">Worse, there is no specific penal provision either in the Motor Vehicles Act or the rules to impose fine on those who park trucks laden with iron rods and construction material without sufficient and clear warning for other motorists. SC issues notice to Centre on recklessly parked trucks -Dhananjay Mahapatra |

'SaveLife Foundation', an NGO, used the Right to Information (RTI) Act to collect details of fatalities resulting from collision of vehicles with these haphazardly parked trucks, many of which carry construction material, including iron rods and angles. The NGO said there was no law to punish the drivers and owners of these trucks, which caused accidents resulting in the death of 8,304 people in two years (2009-11) in eight states. A bench comprising Justices T S Thakur and J S Khehar issued notice to the Union government after hearing brief arguments from senior advocate Indu Malhotra, who on behalf of the petitioner, pleaded that the court should order that only covered containers should carry the rods. It also sought striking down of Rule 93(8) of Central Motor Vehicles Rules, which permit vehicles to carry objects protruding from their body frame. Rajasthan saw the most deaths, with 2,480 people killed in two years, followed by Andhra Pradesh which witnessed 2,134 deaths caused by 6,432 accidents. Delhi saw 1,731 accidents involving heavy vehicles resulting in 787 fatalities, of which 405 were caused by those carrying iron rods jutting out of body frames. In Chhattisgarh, the two-year period saw 856 deaths, Haryana 481, Assam 585, Uttarakhand 272 and Himachal Pradesh 709. Quoting Motor Vehicle Rule 93(8), the petitioner said it permitted trucks to carry iron rods protruding up to one or two metre beyond the rear. "Such protrusions are causing severe harm to motorists and other road users. Keeping in mind Indian road and traffic conditions, it is a provision that permitted trucks to imperil the lives of thousands of motorists," the NGO said. Worse, there is no specific penal provision either in the Motor Vehicles Act or the rules to impose fine on those who park trucks laden with iron rods and construction material without sufficient and clear warning for other motorists. "The penalty usually levied in such cases is done under the heading - general provision for punishment of offences - under Section 177 of the Act, which is a mere Rs 100," it said. Apart from mandating carrying of iron rods within compact containers, the NGO suggested a series of penal measures. It said the owner of the transport company or persons hiring the vehicle and the driver be made jointly and severally liable, both civil and criminal, for any injury caused by such vehicles. Moreover, trucks or other heavy vehicles stationed on the road or road-side must be barricaded by traffic cones and reflector tripods at least from a distance of 50 metre from the rear of the vehicle and all states must adopt uniform regulations in respect of stationary or stalled vehicles on highways and expressways as well as for trucks carrying iron rods and bars. |
