The court observed that the case was once taken up by the court and there are no new circumstances prevailing now to order a fresh inquiry as an FIR was already filed and a probe conducted. The court observed that the case was once taken up by the court and there are no new circumstances prevailing now to order a fresh inquiry as an FIR was already filed and a probe conducted. <em>KOCHI/ KATTAPPANA: </em>The Suryanelli rape victim is expected to move higher courts to get P.J. Kurien, Deputy Chairman of the Rajya Sabha, arraigned as an accused in the case.<br />

Sources close to the victim said that her decision was taken after the Peerumade Judicial First Class Magistrate Court rejected her private complaint on Saturday. The girl had pleaded for a court order instructing the police to register a fresh case against Mr. Kurien.<br />

The court observed that the case was once taken up by the court and there are no new circumstances prevailing now to order a fresh inquiry as an FIR was already filed and a probe conducted. The complaint, filed by her counsel on Saturday cited the revelation made by Dharmarajan, the third accused in the case.<br />

The victim had also filed a complaint seeking a court order to get a police case registered.<br />

Commenting on the new development, Sivan Madathil, advocate at the Kerala High Court, said that the revelations by Dharmarajan and Annamma, wife of P.K. Idicula, made recently could be treated as fresh oral and documentary evidence, calling for a fresh probe in the case.
