Ranchi: The state government has failed to arrive at a formula to end the Nagri land imbroglio and will once again seek time from Jharkhand High Court during a hearing tomorrow. Sources said the state government affidavit, to be filed by the Ranchi district administration, would comprise details of two rounds of inconclusive talks with the villagers and will seek more time to resolve the issue. “We are pursuing the case but we have not reached any settlement with the villagers. So, we will request for more time to find a settlement,” said a top government source, requesting anonymity. This will be the third instance of the government seeking time from the court. Notably, while giving a detailed order on July 16, the court had granted time to the state government to file a status report by July 31, which the government failed to do. A high-level committee, constituted by the state on July 11, could not break ice with the villagers and left it to chief minister Arjun Munda to decide the issue. The villagers have remained adamant about not parting with their land. The dispute involves ownership of around 227 acres in Nagri, including 13 acres for a proposed Ring Road, where the campuses of IIM-R, NUSRL and IIIT are coming up. Villagers claim the state’s land acquisition procedure followed in the 1950s were faulty and that they were in possession of the land and also paid taxes to the government till 2011. Though the chief minister has been silent on the issue, sources close to him said he would probably speak once the land reforms and revenue department sent him the file concerning the high-level committee’s report. According to Rules of Executive Business, the file has to be routed to the chief minister through the chief secretary. Deputy chief minister Hemant Soren, however, said the chief minister should make an announcement in this regard. “The committee has done its job and now it is for the chief minister to take a call and make a public announcement of the solution,” he told The Telegraph. Hemant’s father and JMM boss Shibu Soren has already publicly expressed his desire to get the acquired land returned to the villagers. Meanwhile, the villagers are also eagerly waiting for the high court order. “We are waiting for tomorrow. We do not know what the government is going to inform the court. Thereafter, we will chalk out our plan of action,” said Ranjeet Toppo, a Nagri resident and member of the core committee of Jameen Bachao Sangharsh Samiti. A senior lawyer, requesting anonymity, said the government’s failure to find a solution had given rise to an unfortunate situation. “It was the state government which acquired the land and allotted it to the law university, besides IIM-R and IIIT. It was not the decision of the high court. So, the government should take a stand and perform its duty and not give a message that the high court was forcing the government to get the land,” he said. The court, in its July 16 order, had clearly said land acquired cannot be returned as it had been taken over by the government for the purpose of development of the state. The court had also said Section 48 of the Land Acquisition Act of 1894 says if the government wants to withdraw acquisition, it can do only for the land of which possession had not been taken. “In this case, not only possession has been taken by the government but possession has been handed over to three prestigious institutions coming up in the state,” the court had observed. |
