Women’s right to decent loos upheld by HC -Rosy Sequeira

MUMBAI: Women have the right to have safe and decent toilets at all convenient places, observed the Bombay high court on Wednesday upholding the "right to pee" for women who are outdoors.

"Women have the right to safe and clean toilets which in a way impacts their right to live with human dignity,'' said a bench of Justice Abhay Oka and Justice Revati Mohite-Dere in their judgment. "One of the paramount duties of the state and the corporation is to improve public health by providing toilets for women at all convenient places."

The court has directed municipal corporations across Maharashtra to "formulate a comprehensive scheme for construction and management of toilets/urinals/restrooms/privies for women walking on the streets". The scheme may provide for payment of charges for their use, it added. The toilets should be made available 24x7 or at least from morning to night where the former is not possible. The directions were issued on a public interest litigation (PIL) by NGO Milun Saryajani.

The bench said emphasis should be on providing facilities "at the right places where they are needed the most". Within four weeks, a committee headed by the civic chief has to be set up identify suitable locations for the toilets.

The judges have posted the matter next on March 8, hoping "that by Women's Day all corporations will make compliances earnestly''.
