2G trial moves to Tihar, accused upset

The 2G trial will be held within Tihar jail from Thursday with Delhi High Court ordering the shift of the special court from its existing location in the heart of the capital.

The relocation stunned most of the accused, including former telecom minister A. Raja as well as his DMK colleague and Rajya Sabha MP Kanimozhi. Other accused joined the duo in protesting the move.

Special judge .P. Saini announced the shift, reading from a high court notification he received today.

“The acting chief justice and judges of this court (high court) have been pleased to order that the trial of the 2G spectrum cases shall be held in the Tihar complex according to law,” Saini said as he read out from the notification.

Moments later, Raja objected by saying: “I do not know what is happening in this country.”

A defence counsel said they had requested the judge to shift the trial because of lack of space in the present courtroom at the Patiala House complex. The place, near India Gate, is also close to the high court and the Supreme Court.

But the lawyer contended today that they had never asked for the trial in the jail complex, around 15km away in Delhi’s west.

“We never wanted a place as big as the one in Tihar. We will challenge the notification in the high court on Wednesday,” he said.

Other lawyers argued that the shift would create “problems for everybody”. “Everybody will have to get an entry pass to enter Tihar to attend the proceedings. It is strange that the high court has decided to shift the court without giving valid reasons,” said the lawyer.

Kanimozhi claimed the shift would inconvenience her lawyers and make consultations difficult. “We engage senior lawyers, they will have to now come all the way to Tihar jail for this case only. It will be a problem for them,” she said.        

Raja put forward a similar argument. “Till now, the lawyers could reach Patiala House courts from the Supreme Court or the high court within 10-15 minutes but it would not be possible for them to reach Tihar as they would have to leave all their other cases,” Raja, himself a lawyer, said.

Another unarticulated fear is that that the elaborate entry formalities in the high-security Tihar complex would make it difficult for the accused to meet their relatives and families as regularly as has been possible in the more accessible Patiala House complex.

Trials in the Supreme Court-appointed special court began on November 11.
