4.5 lakh NGOs likely to come under ambit of Lokpal by Himanshi Dhawan

All non-government organizations (NGOs), which receive donations from the public or receive foreign funds in excess of Rs 10 lakh, could come under the ambit of the Lokpal, according to the recommendations of the parliamentary panel on citizens' ombudsman's draft report. Significantly, this provision will allow NGOs run by activists like Anna Hazare, Arvind Kejriwal and Kiran Bedi and other Team Anna members to come under the anti-corruption watchdog. 

If accepted this will mean that the Lokpal will have jurisdiction over 1.7 lakh Central government employees (group A and B) but over 4.5 lakh NGOs. For Team Anna members, who have been at the receiving end of income tax notices, police complaints and inquiries, this provision being revived is unlikely to bring any cheer. 

The standing committee on law and justice has recommended that NGOs, media firms or companies that are either wholly or partly financed by the government, receive foreign funds above Rs 10 lakh or receive donations from the public should be accountable to the Lokpal. 

The provision to include public sector firms, NGOs and trusts within the Lokpal was part of the government draft. Team Anna have repeatedly reiterated that they are not opposed to NGOs, media and even companies being brought under Lokpal but all government employees should also be included. They had argued that the proposed Lokpal bill would have jurisdiction over only a small group of Central government employees but will cover nearly all NGOs including those registered, unregistered, movements, trusts. Another cause for concern was that the structure envisaged by the government and retained by the standing committee - an 11-member Lokpal - will be flooded by complaints and collapse under the weight of the work. 

The draft Lokpal report was circulated among the committee members on Monday. The draft is expected to be discussed and finalized on November 30. The panel has still not reached a conclusion on the issue of how the Prime Minister's post should be covered, if at all. The report has recommended the exclusion of higher judiciary and citizens' charter from the bill. It recommends that group A and B Central government employees be included, but not C and D. It has also ruled against bringing the conduct of MPs within Parliament accountable to the Lokpal.
