A Clean-Up Act In Judiciary: Collegium Wants Mass Transfer, say sources -A Vaidyanathan

New Delhi: The Supreme Court Collegium -- a panel of senior judges headed by the Chief Justice of India -- has recommended mass transfer of High Court judges who have been accused of corruption and misconduct.
 
Judges from the High Courts of Delhi, Karnataka, Madras and Andhra Pradesh figure in the transfer list, sources said.  
 
The list includes CS Karnan, the controversial judge of the Madras High Court Justice who had initiated contempt proceedings against the Chief Justice of Madras High Court. Sources told NDTV that Justice Karnan will be shifted to the Calcutta High Court.
 
This is the toughest punishment the collegium can give, since judges can be removed only by Parliament thorough impeachment.

The decision was taken after the collegium - the judges' body that appoints judges - met recently and examined complaints of corruption, inefficiency, misconduct and nepotism.

A similar move was made during the tenure of Justice SH Kapadia as the Chief Justice of India in 2010.

The system of judges appointing judges had drawn much criticism over the years. Critics not only spoke of lack of transparency in the appointments, but also alleged that no action was taken against judges who were accused of corruption.
 
Since coming to power, the NDA government had enacted a law constituting National Judicial Appointments Commission, which included executives besides Judges to select Judges. But the law was struck down by the Supreme Court and the collegium system was restored.
 
This was the first major exercise by the collegium after it was revived.
