Advance bail in SC/ ST case -R Balaji

New Delhi: The Supreme Court has granted anticipatory bail to four people accused under the SC and ST (Prevention of Atrocities) Act two months after ruling against the act's provisions that mandate automatic arrests and prohibit anticipatory bail.

Maharashtra-based gender rights activist Trupti Desai, her husband and two others associated with her NGO had been accused of abusing a Dalit by his caste and robbing him in July last year.

The bench of Justices L. Nageshwara Rao and M. Shantanagoudar granted them anticipatory bail on Monday after advocate Sushi Balwada pleaded that his clients had been falsely implicated and feared imminent arrest

The apex court issued a notice to the Maharashtra government and the complainant and posted the next hearing for July, which means the accused cannot be arrested till then.

Trupti, who runs the Bhumata Brigade Sangathan, says the complainant had registered a false complaint after being accused of collecting donations on the NGO's behalf without authorisation.
