AG's letter belies Orissa govt's claim on Vedanta clearance by Rajaram Satapathy

A letter written by the attorney general to environment and forest minister Jairam Ramesh proves that the SC had never granted forest clearance for the Vedanta project on its own nor did it restrict the ministry's role on the issue.

The letter is in contrast to the allegations made by Orissa government and BJD leaders that the SC had granted forest clearance to the project and that the Centre's decision was "politically motivated".

Jairam before taking the decision on Vedanta mining project had kept his record straight. He had even sought the AG's opinion whether the Supreme Court's decision to grant forest clearance was final and binding or was it subject to approval and ratification by the MoEF. "Before a decision on the merits of the case could be taken, there were some questions regarding the role and procedure to be followed by the MoEF. By virtue of the fact that the Supreme Court in its judgement dated August 8, 2008, had 'granted' clearance to the project, there were doubts raised as to what role that left for the MoEF to discharge," the minister wrote to AG Goolam E Vahanvati.

The AG replied that the SC was aware that Vedanta was "seeking clearance from the court even before its proposal was placed before the Central government".

Orissa looks for other mines

In view of the Union government temporarily withdrawing environment and forest clearance to Vedanta's plan to mine bauxite from the ecologically fragile Niyamgiri Hills, Orissa government has started exploring alternative mines that can be given to the company to run its alumina refinery at Lanjigarh.

Official sources said that the government is considering to move the Supreme Court against Tuesday's decision of the MoEF, as the apex court had earlier given green signal to mine the Niyamgiri reserves with certain conditions.
