A day after Goa governor S S Sidhu was summoned by the State Information Commission (SIC) for denying information under the Right To Information (RTI) Act, social activist Aires Rodrigues filed a caveat in the high court of Bombay at Goa anticipating that the governor may move the HC against the SIC notice.

In his caveat before the high court, Rodrigues has prayed that no order be passed without notice to him on any petition that may be filed before it by the governor or his special secretary.

A caveat is a formal notice by an interested party to a court requesting the postponement of a proceeding until the person who files the caveat is heard.

The SIC had sent the notice on Wednesday directing the governor to personally appear before the State Chief Information Commissioner at 10.30am on January 4, 2011. This is perhaps the first time a high constitutional authority such as a state governor has been asked to personally appear before the SIC.

The commission issued a notice to the governor as his office had stated that it was not a public authority and refused to part with information sought by Rodrigues on action taken against state advocate general Subodh Kantak.

Rodrigues by an application on November 29, had sought details regarding action taken on the complaints made by him to the Goa governor against the advocate general from Raj Bhavan under the RTI Act.

On November 30, the governor's special secretary N Radhakrishnan, who is also the public information officer ( PIO) wrote back declining to furnish the information stating that information under RTI Act could not be furnished as the governor is not a public authority and that an affidavit to this effect has been filed before the gigh court of Bombay at Goa.

Speaking to TOI, Rodrigues said that he had filed a caveat in the high court as in 2008, the then Goa governor had managed to get an ex-parte stay against the order of the Goa SIC.

Goa State Information Commission by an order dated July 30, 2008 had directed the Raj Bhavan to furnish information sought by leader of Opposition, Manohar Parrikar, under the RTI Act. The Raj Bhavan moved swiftly and on August 4, 2008 challenged the Commission's order before the high court. On August 5, 2008, Raj Bhavan obtained an ex-parte stay order from having to furnish information to Parrikar. Though the high court had directed that the matter be expeditiously heard it has not come up for hearing for over two years, he said.

Parrikar under the Right To Information Act had sought a copy of the reports sent by the then governor to the Union home ministry on the political situation in Goa during the period from July 24, 2007 to August 14, 2007.
