Krishak Mukti Sangram Samiti (KMSS) leader and RTI activist Akhil Gogoi was today granted bail by Gauhati High Court in connection with the case filed by Assam police, alleging his involvement in the June 22 violence at Dispur Last Gate.

A single bench of Justice Anima Hazarika granted bail after the police submitted the case diary before the court. Akhil’s lawyer Santanu Borthakur said, “The court, after going through the case diary, found no material and evidence suggesting his involvement in the violence and said his further custodial detention was not required.”

The court, however, asked Akhil to seek permission from the Kamrup chief judicial magistrate before moving out of the state.

The KMSS leader was arrested on June 24 in connection with case number 1259/2011, registered at Dispur police station, and was booked under Sections 143, 144, 146, 147, 149, 333, 339, 353, 425, 427 and 436 of the IPC, read with Sections 3 and 4 of the Prevention of Damage to Public Property Act. Akhil had moved the high court seeking bail on June 30 after he was sent to judicial custody on June 26.

Magsaysay awardee activist, Sandeep Pandey, and representatives of at least 15 national organisations today demanded withdrawal of cases against the RTI activist and held the state government responsible for the violence.

“The Dispur incident was unfortunate and we believe that the government was totally responsible. People were protesting in a democratic manner but the government did not respond to them properly,” Pandey said here at a news conference.

Ashok Choudhury of the National Forum of Forest People and Forest Workers and Bodhisatwa Ray of the natural resource-based Working People’s Federation, an umbrella organisation of at least 14 NGOs, also demanded Akhil’s release and land rights.

The organisations also said Akhil was never engaged in Maoist activities and led a mass movement for basic rights of the poor through democratic means. “I know Akhil Gogoi for many years and he has been fighting for the basic rights of the poor. I strongly believe that he was never associated with any violent group and the way the government is dealing with Akhil is undemocratic,” he said.
