Binayak Sen walked out of prison this evening to warm hugs from his mother, wife, daughters and friends but not before technical problems relating to his bail threatened to stall his release today.

Eventually, the frail 61-year-old in kurta-pyjamas emerged from Raipur Central Jail a couple of hours later than expected, ending his four-month stay behind bars under a bail condition that requires him to surrender his passport.

The rights activist, granted bail by the Supreme Court three days ago, told a large crowd of supporters and reporters that he was “happy to be released” and would continue his work with tribals and the dispossessed.

“I am very, very happy today,” said Anusuya, Sen’s 84-year-old mother who had travelled alone from Calcutta and reached Raipur this evening.

“I wish everybody should be as happy as I am this evening. We hugged each other. No words came out. I kissed him.”

She said her son smiled and said nothing. “He looked fine. He looked very happy. He smiled. He said nothing. We were emotionally spellbound. We couldn’t say anything. Today is a special day.”

Sen’s wife Ilina and daughters Aparajita and Pranhita had reached Raipur this morning with friends and rights activists. They submitted a certified copy of the apex court order to the trial court which, the top court had said, would set the bail conditions.

Around 3.30pm, the additional district and sessions court that had handed Sen a life term for sedition announced a bail bond of Rs 50,000 and an equal amount in surety. Judge B.P. Verma said Sen could not leave the country without permission and must appear in person at all the high court hearings of his appeal against his conviction.

Delay threat

But after furnishing the bond and necessary papers, the Sen family had a scare when the court noticed technical flaws in the documents (the land deed the person submitting the bond has to furnish). For a while, it seemed Sen would not be freed today.

Eventually, the flaw was rectified and the document submitted once again, and the family reached the jail at 5.30pm, clutching the release warrant. Sen walked out around 7.15.

Sen had been convicted of sedition and conspiracy to help Maoists build a network in Chhattisgarh, but the apex court said on Friday: “No case for sedition has been made out.”

It questioned the state government’s claim that Sen had passed letters to imprisoned Maoist Narayan Sanyal and Calcutta- based businessman Piyush Guha while visiting them in jail.

Sen could be a Maoist sympathiser, the court said, but added that mere possession of Maoist literature could not amount to sedition in a democratic country.
