NEW DELHI: Competition Commission of India is investigating if rating company TAM Media Research Pvt Ltd abused its dominant position in violation of the Competition act.

It has asked the company to furnish details on whether it has imposed conditions of exclusive supply that resulted in foreclosure of the market for competitors and provide details if it had created entry barriers, including regulatory ones. TAM has been given time till July 18 to respond.

The CCI in May observed that prima facie TAM abused its dominant position in measurement of television rating points by not reflecting choices of rural TV households. The order was issued in response to Doordarshan's complaint in November 2012 accusing TAM was suppressing data and not reflecting its extensive terrestrial network.

In its notice dated June 27, CCI said it was conducting an investigation under section 26(1) of the Competition act on the basis of information furnished by Prasar Bharati against TAM where it has been alleged that the firm was "abusing its dominant position" in violation of section 4 of the act.

The watchdog has sought information related to TAM's sources of revenue, market share in the market of television audience measurement between 2009-2010 to 2012-2013. CCI has also asked for TAM's response to these allegations.

Among the questions the commission has asked TAM are whether TAM used its position to get advantage or leverage in other markets, whether it indulged in any practice resulting in denial of market access to its competitors, details on entry barriers including regulatory barriers, cost of capital, technical barriers, economies of scale and if such barriers were created by TAM.
