A government-owned forensic laboratory has reported that a CD allegedly containing a conversation between former law minister Shanti Bhushan and Samajwadi Party leader Mulayam Singh Yadav has not been tampered with, providing a further twist to a saga that has had Delhi's political class enthralled. An official, who has seen the report, told ET that the Central Forensic Science Laboratory (CFSL) has concluded the recording was authentic, clear and continuous.

"The signed report clearly says there is no tampering, splicing or interpolation and (the tape) is in continuity," said the official. He spoke on condition of anonymity because Delhi Police, which is investigating the case, has not come out with an official statement. On Wednesday evening, Shanti Bhushan's son Prashant Bhushan accused the government of waging a campaign against him and his father and denounced the credibility of the CFSL.

"For any lab to say this is not tampered with, it will be so utterly dishonest. It shows to what extent the government will go to smear us. This report, if true, shows that powerful sections within the government and corporates are involved in fabrication of this CD. It also shows the government has become a party to fabricate this CD. Almost all of Mulayam Singh's conversations have been lifted from a conversation in the Amar Singh tapes. The tampering is undeniable. How can anyone say no tampering has taken place?" "They have got a totally absurd report from the government laboratory," the younger Bhushan told ET over his mobile phone.

CFSL Report Sent to Delhi Police

The government has given away the fact that it is responsible for this fabrication and not merely Amar Singh," Prashant Bhushan told ET.

The report by the CFSL was sent on Tuesday evening to Delhi Police. It contradicts two reports furnished by Shanti Bhushan and his son Prashant, a prominent lawyer, which said the recordings were spliced or put together by combining separate conversations. Since the voice sample of Shanti Bhushan was not submitted, the report does not confirm whether the voice is of the former law minister.

The Bhushans have maintained the tapes were spliced. The CFSL is a government-owned laboratory that specialises in forensic investigation. It is under the administrative control of the CBI and under the overall control of the home ministry. The CFSL director could not be reached for comment.

A spokesman for the CBI said he would check with the CFSL and revert. Delhi Police had forwarded the tape to the CFSL after the Bhushans lodged an FIR. "Unlike private labs, the CFSL can be criminally prosecuted if the report is incorrect and, therefore, there is no reason for the lab to put out an incorrect report," said a Delhi Police officer involved with the investigation.
