The conspiracy of favouring candidates in the JBT exam by former chief minister Om PrakashChautala had begun in 1999 and he had even transferred two officers who did not comply with the directions given by chief minister's office.

In its order, the court said Chautala was the "main conspirator" who was aware of every development in the scam.

The court on Wednesday noted that Chautala could not carry out his plan initially as he was heading a coalition government but as soon as his party - Indian National Lok Dal (INLD) - got full majority in February-March 2000, he got the opportunity to execute the conspiracy.

"Profuse evidence is available on record to show that it was Om Prakash Chautala, who was managing the whole affairs. First he took out the JBT vacancies out of the purview of Staff Selection Commission, then he increased the interview marks from 12.5% to 20%. However, he could not materialize his intentions due to prevailing political situation where he was running a coalition government. As soon as the Indian National Lok Dal got full majority of its own in the elections held in February-March 2000, the opportunity to execute the conspiracy was available," special CBI judge Vinod Kumar said.

The investigation had revealed that two officers in the education department were transferred intentionally. "When R P Chander (IAS officer), the then director of primary education, moved the proposal to declare the results on April 24, 2000, he was transferred two days later. Thereafter, Rajni Shekri Sibal (IAS) was brought in as director of primary education. She was asked to change the award lists by Sher Singh Badshami, political advisor to chief minister in presence of Vidya Dhar (officer on special duty to the CM) as well as in the presence of Ajay Singh Chautala (Chautala's son) and they were all acting under the directions and wishes of Om Prakash Chautala. When Sibal recommended compilation of the result vide her note sheet dated June 20, 2000, she was also transferred on July 11, 2000 and accused Sanjiv Kumar was appointed in her place," a CBI officer said.

The investigation revealed that before she was transferred, Sibal had enclosed the almirah in which award lists of all JBT teachers were lying with four metres of cloth wrapped on it. "After giving charge, Om Prakash Chautala called Sanjiv Kumar and told him that mandate for him was to change the award lists of JBT candidates with fresh award lists in which the candidates favourable to him/his party should be favoured.

"Sanjiv Kumar somehow took out the award lists from the said almirah and thereafter called the chairpersons and the members at the guest house in Chandigarh in last week of August 2000 and at Haryana Bhawan, New Delhi on September 1, 2000, gave photocopies of some of the award lists to them and instructed them to prepare fresh award lists with a new pattern of marks and by giving specific roll numbers and the marks to be awarded to them," the CBI officer said.

Officials said Ajay Chautala held telephonic conversations with Sanjiv Kumar on the dates when these meetings took place.

The change of list, CBI said, prepared on the basis of the fake award lists served three purposes. "First, a formula was effected vide which the favourable candidates were given 17 or more marks irrespective of caste and category so as to ensure their success in the joint merit list. In order to achieve this object, rest of the candidates were given very low marks in the directorate lists. The second objective was that the reserved categories, which were encroaching the space for general candidates, were reduced in such a manner that minimum vacancies of general candidates were occupied by them. Third purpose was to favour the candidates of some districts like Bhiwani," the officer said.

The chain of events described by the agency found merit in the court's order which said, "This is a complete chain of circumstances which pin down accused Om Prakash Chautala as the main conspirator. I may point out that the notings file would show that almost at each and every stage, the note sheets have gone up to the chief minister for his approval. From this, an inference can be drawn that Om Prakash Chautala was kept apprised of each and every development in these selections."

The court added, "Thus, the conspiracy which started from taking out the vacancies of JBT teachers out of the purview of the Staff Selection Commission vide cabinet decision dated September 8, 1999 was fully executed and successfully ended when the successful candidates based on the fake lists were given appointments in October 2000. Hence, a complete chain of events involving all the accused persons in commission of this offence stands proved beyond reasonable doubt."
