Chidambaram flags three amendments proposed to Armed Forces Act-Vinay Kumar

A Union Home Ministry's proposal for amendments to the Armed Forces (Special Powers) Act is pending with the Cabinet Committee on Security (CCS), P. Chidambaram said on Saturday, a day after the United Nations Special Rapporteur asked India to repeal the law, arguing that it had no place in a democracy.

Answering questions at his monthly press conference, he said his Ministry had sought three amendments. “These pertain to three sections…”

He was asked about the suggestion made by Christof Heyns, U.N. Special Rapporteur on Extra-judicial, Summary or Arbitrary Executions, that the Act be repealed as it was a “symbol of excessive state power.”

Mr. Chidambaram said the remarks of the Rapporteur were both negative and positive: “The Rapporteur has praised the openness and willingness of the government of India to engage, shown also by the fact that it was willing to host a mission dealing with the right to life, an area in which issues to be tackled are often complex in various countries.”

On the Rapporteur's views on the Act, he said: “Yes, we take note of the view, but that's not a novel view as there are a number of people who have expressed the same view, and there are others who have a contrary view, which is why the issue remains unresolved.”

“After considering the Justice [B.P.] Jeevan Reddy Commission's report and all other reports, the view of the Ministry of Home Affairs is that three amendments should be made to the AFSPA,” Mr. Chidambaram said, without elaborating on the proposed changes.

However, government sources said the amendments would make arrest warrants mandatory; divest the armed forces of the power to open fire causing death; and set up a grievance redress cell.

As reported in The Hindu in October 2006, the Justice Jeevan Reddy Commission's report, though not made public, has recommended the repeal of the law. People and activists in Manipur and elsewhere in the Northeast, and Jammu and Kashmir, have been protesting against the law for several years. The commission submitted its report in June 2005, but the UPA government has not taken any decision on it.
