Recommending civil society vigil to check female foeticide, a Parliamentary committee has asked the Union Government to ensure that the Medical Termination of Pregnancy (MTP) Act, 1971, is not circumvented to give way to selective abortion in cases of female foeticide. It has also called for synchronisation of this Act with the Pre-Conception and Pre-Natal Diagnostic Techniques (Prohibition of Sex Selection) Act (PC&PNDT Act), 1994, to check the social evil.

It has recommended incorporation of effective checks into the MTP Act so that each case that comes under the Act is thoroughly assessed in the light of facts and circumstances to rule out sex-selective abortion.

A report of the Committee on Petitions on “Urgent Need to Curb Female Foeticide”, tabled in the Rajya Sabha, says it endorses suggestions received from civil society that pregnancy be tracked by Accredited Social Health Activist (ASHA) workers and related non-government organisations. The Committee has expressed hope that such a mechanism will act as a social check against sex-selective abortion.

There are concerns about contradictions between the provisions of the two Acts. Though the MTP Act declares abortion legal only if done within 12 weeks of pregnancy and only as a last resort in the event of a contraceptive failure, the Committee recommends abortion may also be done between 12 weeks to 20 weeks on the advice of two doctors under certain conditions in the interest of the mother and the foetus. The problem is that the gender of foetus can be ascertained through ultrasound in the 15th week of pregnancy. The abortion is done within 14 weeks in connivance with unethical medical practitioners under the veil of the MTP Act by concealing the duration of the pregnancy.

Further, the Committee says it has information that the gender of the foetus can be known from a blood sample even before the 10th week. In that case, the sex-selective abortion can be done under MTP as a normal case.
