NEW DELHI: The rift between the Prime Minister's Office and the Congress is once again out in the open over passing of a landmark legislation to prevent diversion of funds earmarked for Scheduled Castes/Tribes, a core constituency that Congress has lost steadily.

The latest bone of contention - the Scheduled Caste Sub Plan and Tribal Sub Plan Bill 2013 - is ready for the consideration of the Cabinet. While Congress ministers and functionaries are lobbying hard for passing the legislation in the forthcoming special session next month, the PMO is insisting the Bill be referred to committee of secretaries for further examination.

The draft bill was prepared by the Ministry of Social Justice and Empowerment, along with a note in December last year. The ministry has been insisting that the Bill be pushed through in the February session itself. The Congress had committed itself to the Bill in its January 2013 Jaipur Chintan Shivir.

According to sources, social justice and empowerment minister Kumari Selja met Prime Minister Manmohan Singh last week and later shot off a letter urging him not to refer the Bill to committee of secretaries as it could delay the landmark legislation unnecessarily.

"Ministry of law is in the final stage of vetting. Meanwhile, Cabinet Secretariat on January 1 requested this department (Ministry of Social Justice and Empowerment) to send a note for consideration of committee of secretaries. You would appreciate that referring the matter to committee of secretaries at this stage would delay the process at a time when Cabinet note and Bill is under finalisation of the ministry of law," Selja has written in her letter.

The legislation, which is on the same lines as the Bill recently passed by Congress governments in Andhra Pradesh and Karnataka, aims to prevent diversion of funds and spend allocated funds for schemes that directly benefit SC/STs.

According to sources, Congress vice-president Rahul Gandhi's trusted lieutenant K Raju, who has recently been appointed as the head of party's Scheduled Caste wing, has even approached party president Sonia Gandhi to intervene.

The party wants to push the legislation as it would directly affect Dalits and Tribals, a core constituency which has successfully been weaned away by BSP and BJP over the last decade.
