Court asks Centre to phase out diesel cabs from entire NCR -Abhinav Garg

NEW DELHI: The Delhi high court on Thursday asked the Centre to explore the possibility of extending the ban on diesel cabs to the entire National Capital Region (NCR) "even if the Motor Vehicles Act has to be amended" for the purpose.

Justice Manmohan said he wanted the Union cabinet secretary to head a panel comprising secretaries of environment, transport and petroleum ministries to hammer out a plan to make NCR diesel-free for cabs.

Saying diesel had become a "rich man's fuel", the judge was also in favour of making private diesel cars "a bit unattractive" to check vehicular pollution.

The judge said an inter-ministerial panel must coordinate with Delhi's chief secretary and other bureaucrats to find ways to keep diesel cabs away from NCR.

"The entire fleet of cabs must be shifted ultimately to CNG," the court said, asking Centre and Delhi government to explore feasibility of setting up such a panel.

While the court admitted it had to confine its orders to diesel cabs, Justice Manmohan reminded the governments it was high time they "revolutionized the transport sector" by reducing diesel-run vehicles in general.

"Urge or greed to buy vehicles must stop. What is use of thousands of cars if one dies of pollution," he observed.

"It (air pollution) is a very big problem, why are you not getting any registration policy on diesel vehicles? The entire MV Act needs to be reviewed so that you can deal with diesel vehicles. These need to be regulated. You can levy some cess; it is a rich man's fuel. A very big policy decision is needed from the legislature," Justice Manmohan observed.

Central government standing counsel Manish Mohan assured the court he will seek instructions and report to court on December 15.

The court, meanwhile, directed app-based cab service providers, including Ola and Uber, to furnish details, including registration numbers, of all the vehicles registered with each of them. These details are to be given in a sealed cover and shall remain sealed to protect confidentiality of the information, the court said.

It also directed the companies, which have been granted an interim protection from the January 1 ban order of Delhi government, to give the number of diesel cabs they are phasing out every month to meet the HC's deadline of March-end next year.

Delhi government had on January 1 banned the operation of app-based cab services till they complied with the guidelines of the Radio Taxi Scheme of 2006, which was amended on December 26 last year.

HC is hearing a plea filed by Association of Radio Taxis seeking proper enforcement of ban on diesel cabs providing point-to-point service in the national capital. HC had on October 14 allowed app-based cabs to ply diesel-run taxis from point-to-point in the national capital till March 1 next year. by when they would have to shift completely to CNG.
