Respondents given four weeks to respond to mother's plea

Guwahati: The Gauhati High Court on Tuesday issued notices to the Assam government, the Board of Secondary Education, Assam (SEBA), and the managing committee and Principal of Kristo Jyoti School in Bokakhat, upper Assam, asking them to show cause in four weeks as to why a petition, which challenged an order of the school authorities - debarring a four-year-old nursery student, Fathima Beevi, from wearing a hijab (headscarf) in the school - should not be allowed.

The girl's mother, Alee Ahmed, filed a writ petition on April 8 pleading the court to set aside the impugned order of the Catholic Mission-run English-medium school of March 28, by which the school authorities asked Fathima's parents to either ensure compliance with the prescribed uniform or withdraw their daughter from the school.

Advocate Jayanta Kumar Goswami, counsel for the petitioner, told The Hindu that the Single Bench of Justice Hrishikesh Roy had given four weeks' time to the respondents to show cause as to why the petition should not be allowed.

Earlier, on April 22, the court granted Mr. Goswami a week's time to prepare himself for the case, considering "the larger issues raised in the matter or the uniform prescribed in a minority educational institution vis-à-vis the dress code as per the Islamic custom."

Islamic practice

"The petitioner is a follower of Islamic faith and her daughter Fathima Beevi is admitted in the Kristo Jyoti School, Bokakhat. As per the Islamic practice, the family expects the student, aged about 4 years to cover her head with a Nakab ( Hijab ), as is the family custom.

"However, since this is contrary to the uniform code prescribed by the Christian minority institution, they have issued the impugned notice dated 28.3.2013, requesting the parents to ensure compliance with the prescribed uniform or to withdraw their daughter, from the school," the court observed in its April 22 order.
