The special judge, Assam, today directed police to file chargesheets against 37 public servants facing corruption charges within a month.

These cases were registered in 16 police stations spread across seven districts of the state.

Special judge Md Mazed Ali passed the order based on reports filed by superintendents of police of all the 26 districts, following the court’s directive, on corruption cases against public servants. Of the 26 districts, corruption cases against government officials were found registered in Nalbari, Nagaon, Kamrup, Kamrup (metro), Dibrugarh, Tezpur and Golaghat. The court has asked the SPs of the seven districts to ensure that the chargesheets are filed within a month in compliance with the order.

The special judge passed the order placing reliance on the Supreme Court ruling in a petition filed by Janata Party leader Subramanian Swamy in the 2G spectrum scam case. The apex court had ruled that the government would have to give its decision on prosecuting a corrupt minister or public servant within four months from the date the investigating agency files a prosecution sanction request.

The 16 cases on which the court passed the order today have been pending for more than four months for want of prosecution sanction from the state government.

In one of the cases, the application seeking prosecution sanction in Mangaldoi police station case number 109/95, registered against the then Mangaldoi circle officer Binod Kumar Deka and his lower division assistant Babul Saikia for allegedly taking illegal gratification for furnishing land valuation certificate, is pending before the secretary of the state home and political department for the past 16 years. The investigation officer of the case had filed the application seeking prosecution sanction on October 6, 1995.

Another case (number 210) registered at Nalbari police station in 2001 against 14 education department officials for issuing 4,200 appointment letters to teachers of lower primary schools under Operation Black Board scheme after allegedly taking a bribe of Rs 20,000 to Rs 40,000 from the teachers is still pending for want of prosecution sanction.

The other applications filed by the police in 2003, 2004, 2006 and 2008, requesting the state government to grant sanction for prosecution of corrupt officials, are also pending with the government.

In all these cases, there has been an inordinate delay on the part of the state government in taking a decision on grant of prosecution sanction. The government has not cited any reason for the delay either, creating doubts over its sincerity in fighting corruption.
