CPI criticises Centre's stand on Salwa Judum

The Communist Party of India has protested against the decision of the Centre to support the Chhattisgarh government's move on the Salwa Judum, and urged it to withdraw support to the State government ordinance.

The ordinance, which reappoints the Special Police Officers (SPO) “to do precisely the same activities and with the same qualifications as earlier, shows complete disrespect for the spirit of the Supreme Court judgment [declaring the Salwa Judum illegal],” party MP D. Raja said in a letter to Prime Minister Manmohan Singh.

He said the July 5 judgment declared the appointment of SPOs unconstitutional on the grounds of Article 14 and Article 21, after showing “how they were being used as cannon fodder, and their use in combat operations against the Maoists was both a threat to themselves and to other innocent villagers. The same principle applies to SPOs in other States. The judgment does not upset the constitutional separation of powers, but is based on fundamental rights.”

Referring to a response by Home Minister in Parliament that the Centre did not support non-State actors, Mr. Raja said that in its review petition the government described Salwa Judum as “a movement started by the local people as a revolt against excesses and torture by the Naxalites” when both the Court and the National Human Rights Commission had accepted that the movement had burnt civilian homes and caused grave human rights violations.

“Filing such a review petition does not speak well of the intention of the government to address the problem of unrest in these areas and the very real problems of the adivasis,” he said.

He also said many members of the CPI, including one of the petitioners in the case, Kartam Joga, had been imprisoned by the Chhattisgarh government on false charges and yet none of the Salwa Judum leaders or the SPOs accused of heinous crimes were arrested.
