The Delhi High Court on Wednesday issued notices to the Union Government and the Central Information Commission (CIC) on a public interest litigation by two RTI activists seeking a direction to fill vacant posts of Information Commissioners and the subordinate staff in the CIC.

Issuing the notices, a Division Bench of the Court comprising Acting Chief Justice A.K. Sikri and Justice Rajiv Sahai Endlaw directed the respondents to file replies to the petition by February 15.

The petitioners, R.K. Jain and Amit Shankar, in their joint petition submitted that the fundamental right of the citizens to access information from the public authorities had been marred by the shortage of Information Commissioners and the subordinate staff in the CIC.

At present, more than 20,000 appeals and complaints are pending before the CIC for disposal, and with the growing awareness among public, more and more matters were piling up there, the petitioners submitted.

Under the RTI Act, information must be provided within 30 days of filing of applications but at the moment the applicants had to wait for two years before their cases were taken up for hearing, defeating the object and the express provisions of the RTI Act, the petitioners further submitted.

At present, there were five vacancies of Information Commissioners as no one had been appointed to the post for more than two years, the petition alleged.

The Chief Information Commissioner had himself twice written to the Prime Minister's Office reminding it of the urgent need to fill the vacancies but no initiative had been taken, the petition said.

Though the Government claimed that it had invited applications for filling the vacant posts but the process was very slow, and it would take several months to complete unless the Court gave a direction for that, the petitioners submitted.

There was also acute shortage of subordinate staff in the CIC. According to information available with the petitioners, the Registry and the Secretariat of the Commission was short of as much as 65 per cent of its staff strength.
