Detentions fall under RTI Act: CIC by Khalid Gul

The Chief Information Commissioner (CIC) GR Sufi Friday said that under Right to Information Act, police is answerable to public if they detain any person without any warrant.

“There is a provision in the State RTI Act-2009 wherein if somebody is detained by police without a warrant, his family or relatives can file an application in local police station and the concerned Station House Officer has to furnish this information within 48 hours as to why the person has been detained,” said Sufi, addressing a seminar on RTI in Degree College Kokernag.

He said comprehensive implementation of RTI would prove helpful in providing transparent and accountable administration to the people.

Sufi dwelt at length on the RTI Act and called upon the Public Information Officers (PIOs) to put in their best efforts for its proper implementation and ensure that information sought is provided expeditiously.

He said prompt action on the part of PIOs would not only ensure early dissemination of information but also absolve them of the penalties imposed under the provisions of RTI Act. “The RTI has empowered people as it gives them an opportunity to know about the decisions which can change their lives,” he said, adding, “The Act cannot become popular and strong unless it is debated and discussed by people.”

Sufi said the Act is people-friendly and aimed at making authorities accountable. He said every citizen has the right to know the pace of developmental works in his area and any person can seek information from the authorities within a stipulated time.

He said if the information is not provided within the specific time, one has the right to approach the Commission.

“It is the duty of every PIO to provide the information within 30 days. Even if the information is not provided, the concerned authority has to give in writing as to why information was denied,” the CIC said.

He said as per the RTI Act, any person is entitled to seek information, except the information “which has potential to affect the integrity and the sovereignty of the country or information which has been directed by the Court not to reveal.”

Sufi said the Act would empower the people at grassroots level.
