Disclose letters of plaints against judges, says CIC

In a decision that is likely to reveal the names of judges against whom complaints have been filed in the Law Ministry, the Central Information Commission (CIC) has directed the Law Ministry to make public the forwarding letters attached with such complaints that are forwarded to the Supreme Court and High Courts.

The transparency panel gave this direction while hearing the RTI plea of activist Subhash Chandra Agrawal, who had asked for “only copies of forwarding letters” sent to the chief justice of India and chief justices of high courts.

Earlier, while responding to another RTI application of Agrawal, in which he had asked for copy of complaints against retired and present judges, the ministry had claimed that it cannot provide copy of complaints since they are forwarded to the chief justice of India and chief justices of high courts in respective cases.

Thereafter, Agrawal filed another RTI application seeking a copy of forwarding letters with such complaints.

While hearing the plea of Agrawal, Information Commissioner Sushma Singh found his demand of copy of forwarding letters as “reasonable” and ordered the disclosure of such letters dating back to last one year immediately.

Singh observed that “the Commission finds that the appellant is no longer seeking copies of complaints, he only wants copies of forwarding letters…the request is reasonable.”

She also asked the officials to trace records for three years and provide it to the applicant and directed the Ministry to maintain the records in such a manner that they can be retrieved easily whenever requested for by the applicants
