High Court tells state to install CCTVs to monitor police behaviour

Bangalore: In a people-friendly move, the Karnataka High Court said the State government should install video cameras (closed-circuit television cameras) in and around all police stations to ensure discipline among the police force.

If this is implemented in letter and spirit, people in the near future may walk into police stations without fear of being harassed or ill-treated.

A Division Bench comprising Chief Justice D.H. Waghela and Justice B.V. Nagarathna gave this oral direction on Thursday to Advocate-General S. Vijay Shankar during the hearing on public interest litigation (PIL) petitions complaining against not constituting a police complaints authority, irregularities in police transfers, and seeking a rehabilitation plan for rape victims.

Evidence

Explaining various steps taken to reform the police force as per the Bench's earlier directions, Mr. Shankar submitted that the Criminal Investigation Department (CID) is using video cameras to record statements, and other police stations would soon start using this tool as it is now admissible as evidence in court.

No third-degree

While approving this, the Bench said the cameras should also be installed inside and outside police stations, and near lockups, to prevent third-degree methods for interrogation. Installation of CCTVs would compel the police to adopt accepted methods of interrogation and behave properly with the accused as well as others, the Bench observed. It would also instil discipline and remove police presumption that they can get away with anything.

Acquittal post-mortem

To this, Mr. Shankar said that he would advise the government to take appropriate action.

Meanwhile, referring to the earlier directions of the Bench, the Advocate-General said a March 30, 2013 circular mandated the constitution of a committee in each police range, headed by the respective Inspector-General of Police, to review the investigation in cases of acquittal of the accused in criminal cases and report to the disciplinary authority once in three months for action against the investigation officer or other police personnel for lapses if any.

Similarly, Mr. Shankar said, another committee, headed by the Additional-Director General of Police (Crime) and involving the Director of Prosecution, would review the submissions before the courts by public prosecutors in cases of acquittal and initiate action against the prosecutor if there are any lapses.

The Bench adjourned further hearing till June 12.
