KOLHAPUR (Maharashtra): The state general administration department has issued a notice asking all government sections not to entertain applications under the Right to Information (RTI) Act if they do not constitute "public interest".

The order, coming from an administration under President's Rule, seeks to prevent use of the information to settle personal disputes and is being seen as a relief, especially by government officers who were often targeted with applications seeking information on show-cause notices and orders of punishment issued.

P P Gosavi, deputy secretary of the general administration department, has cited a Supreme Court order dated November 3, 2012, in the notification issued on October 17. The order, given by the Supreme Court in a special leave petition, states, "The performance of an employee or officer in an organization is primarily a matter between the employee and employer and normally those aspects are governed by the service rules which fall under the expression 'personal information' (as defined in clause (j) of section 8(1) of RTI Act), the disclosure of which would cause unwarranted invasion of privacy of that individual".

The state government also referred to a verdict given by the Karnataka high court on August 31, 2012.

"Information which does not constitute any public interest and which would warrant overriding the provisions of Section8 (1) (g) (j) of RTI Act, 2005, are not expected to be provided to the applicant, especially when it is intended to score a personal dispute with the third party and does not constitute public interest," the court had said.

RTI activists, though wary, see the move as a bid to block misuse of the sunshine law. "A section of people had used RTI to blackmail government officers. Several applications had been filed seeking information on the I-T returns of officers. Such information is certainly not necessary in the interest of the public. I think the Act is still just a decade old and such additions or deletions in the provision of Act are necessary to make it foolproof," said city-based RTI activist Dilip Desai.
