Ensure minimum wages to NREGA workers: Activists by Anindo Dey

With the state government agreeing to increase the minimum wages by 35% with effect from January 1, the focus of the on-going Mazdoor Haq Yatra has now shifted to demands that even NREGA be given the minimum wages from the current freeze at Rs 100.

The Yatra originated about a fortnight ago in the state demanding a rise in minimum wages and better implementation of NREGA. The Yatra is supported by many like-minded organisations, including the Aruna Roy Rozgaar Evum Suchna Ka Adhikar Abhiyan.

The activists plan to rake up this issue nationally later so as to ensure guidance that NREGA too falls in the purviw of the Minimum wages Act.

"But as of now we are not concerned how the state pays Rs 135 as wages for NREGA workers but that is just what we want demand. It is upto the state whether it pays the money from its own funds or asks for a reimbursement from the Centre. But as far we are concerned no wages can be less than the minimum wages," says Nikhil Dey, an activists of the Abhiyan.

And that is exactly what the Working Group on Wages under the National Employment Guarantee Council has proposed to the Ministry of Rural Development only to meet with a staunch no for an answer.

The ministry has said: "This is not feasible. The wage rates fixed under Section 6 (1) of the Act are distinct from the minimum wages. The provisions of the Act have to be respected." But while the ministry has its argument additional solicitor general, Government of India, Indira Jaising feels otherwise.

In her opinion on MGNREGA overriding the Minimum Wages Act Indira Jaising on Section 6 of the Act, the section that was quoted by the ministry for not raising the wages, says: "At the first glance, this (Section 6) may lead to the impression that the wage noted under subsection (1) may or may not be a minimum wage fixed under the Minimum Wages Act. However, on closer examination, this view may not be correct."
