‘EU to resolve drugs seizure issue soon’

EU trade commissioner said it will soon resolve the issue of confiscation of Indian drugs being exported to developing countries. EU Trade commissioner Catherine Ashton said a team of customs officials from the European Commission will be in New Delhi shortly to discuss the issue.

“We talked about this issue. Our commitment on pharma, on generics is to find a solution that works for India,” she said after a meeting with commerce minister Anand Sharma. Ms Ashton is here for the India-EU business summit on Friday.

Since the beginning of the year, the EU have been confiscating Indian generic drugs that are on transit to Africa and Latin America, on the ground that it violated the EU’s patent regime. The latest incident was on October 19, when generic anti-clotting tablets ‘Clopidogrel’ manufactured by a Mumbai-based firm was stopped at Paris airport.

The generic Indian drugs exported to developing countries are not patented either in India or in the destinations they are meant to be supplied. However, the medicines are patented in European countries, which leads to their confiscation.

The confiscation of such drugs violates the Trips agreement on public health. The EU’s placatory move follows India’s threat of dragging it to the WTO for violation of the Trips Agreement on intellectual property and diverting its air cargo away from Schipol.

Africa and Latin America are major markets for India’s low-cost drugs used for treatment of diseases like HIV/AIDS, tuberculosis and malaria. The two continents account for around 15% of India’s total pharmaceutical exports of nearly Rs 40,000 crore.
