Face of 2002 riots moves court against Leander Paes starrer film

AHMEDABAD: Qutubuddin Ansari, the face of the Gujarat riots, on Thursday filed a criminal complaint against makers of tennis star Leander Paes' debut movie - 'Rajdhani Express' for using without permission his famous photograph with tears in his eyes and begging for protection with folded hands during the 2002 riots.

Ansari has complained before the metropolitan court that his photograph has been used to "sensationalize the film", but it also promotes communal enmity between two groups by reminding people of the communal strife. He has also claimed that the way his photograph has been used in the feature film is defamatory, for he now faces various problems in society due to projection of his picture in a film.

Ansari has taken strong exception at the film for showing his photo in a police station and identifying him as a common man in depressing need of help, against whom a cop, played by Jimmy Shergill, pulls trigger of a gun in the end of the movie. Ansari, who also got benefactors post-riots due to the wide publication of his photograph, has been requesting people for quite sometime not to use the picture, particularly after a militant outfit Indian Mujahideen used it in a threat mail after serial blasts that rocked the city in July 2008.

To court's query on how the use of a photo amounts to defamation and how section 153 of IPC can be invoked, Ansari's lawyer Amit Nair submitted that Ansari has been facing peculiar problems after the film was released in city theatres last month. Ansari was often accused of accepting money in lieu of the use of his photo. He argued that the photo reminded his client of the sad memories of the violence, when he was facing death.

On Ansari's complaint against film director Ashok Kohli and producer Manoj Kejriwal of SLA Impex, the metropolitan magistrate I M Sardar has kept further hearing on March 18. Last month, Ansari dashed off a notice to film makers requesting them to remove the photo from the movie and to pay Rs 25 lakh towards damages. But since he did not hear anything from them, he filed the criminal complaint, said advocate Nair.
