Freed woman convict demands wages for jail work by Dhananjay Mahapatra

A woman prisoner has sought the Supreme Court's intervention in getting her the wages for the work she was made to do inside the Tihar Jail for nearly four years while serving sentence after being convicted in a criminal case.

Phool Kumari was convicted in a criminal case and sentenced to 10 years imprisonment by a Delhi court. On appeal, the apex court had reduced the sentence to a five-year jail term. However, she was lodged in Tihar Jail from March 24, 2007, to December 23, 2010, for three years and 10 months.

While serving the sentence, she was engaged in assisting doctors in the Out Patient Department (OPD) and also assigned to take care of the cleanliness of the medical inspection (MI) room. However, she complained to the apex court that though other prisoners were given wages, she was released from prison empty-handed.

A bench of Justices P Sathasivam and J Chelameswar entertained Phool Kumari's appeal against the Delhi High Court order refusing any relief to her, and issued notice to the Tihar Jail superintendent.

Kumari had filed a complaint with visiting additional sessions judge Madhu Jain for non-payment of wages for the work she was asked to do inside the prison. The ASJ dismissed her plea on the ground that it was not clear from her petition the periods she worked inside prison as an under-trial or a convict.

She resorted to Right to Information Act and got information from prison authorities that she was one of those convicts who were entitled to wages as similarly placed prisoners in the jail were being given wages.

Under Delhi Prison (Transfer of prisoners, Labour and Jail Industry, Food Clothing and Sanitation) Rules, 1988, "All prisoners sentenced to rigorous imprisonment and such other classes of prisoners who volunteer to labour shall be entitled for wages as specified by government from time to time after deducting expenses on food clothing and other maintenance items of such prisoners. The wages shall be paid on the basis of actual work done according to the prescribed task."

A single-judge bench of Delhi HC in Justice Mukta Gupta had disposed of Kumari's petition on the affidavit by DIG, Prison, who stated that she exercised her choice of not performing hard labour and hence was allotted soft work.The DIG stated that earlier she was assigned hard labour for which she was paid wages.
