The Allahabad high court has refused to entertain a PIL seeking a direction to the Centre to rigorously enforce 2-child norm for every couple with suitable incentives to tackle the alarming increase of population in the last three decades.

A bench of Acting Chief Justice S K Singh and Justice D K Arora agreed with PIL petitioner Nutan Thakur about the importance of the issue, but accepted additional solicitor general K C Kaushik's argument that as the issue related to framing of policy, it squarely fell within the sole domain of the legislature and executive and should be left to them.

Thakur said India with 2.4% of world's land mass was home to 17.5% of the total population, which has increased from 84 crore in 1991 to 121 crores in 2011. She sought a direction from the HC to the Centre to "ensure that 2-child norm is adopted as the National Population Policy and suitable incentives and disincentives are linked to those who follow and do not follow the 2-child norm."

Though the HC agreed with the petitioner on the gravity of the problem posed by population explosion, it said: "All evils facing the country cannot be eradicated only by the State authorities or through law. People can play a major role in tackling the contentious social problem of increasing population."

"Each individual or concerned NGO is required to do so on its own in spreading the awareness and education relating to the issue. At this juncture, we are unable to grant any positive relief to the petitioner in this public interest litigation," the HC said.
